PUBLIC HEARING FOR THE FORMATION OF THE TUSTIN LANDSCAPE
AND LIGHTING DISTRICT
BACKGROUND:
On May 6, 1985, Council adopted Resolution 85-43 for initiation of the Tustin
Landscape and Lighting District pursuant to the Landscape and Lighting Act of
1972; and, directed staff to engage a consultant to prepare the Engineer's Report
and perform all subsequent work as required to formulate and implement the
Assessment District. On July 1, 1985, Council approved the Engineer's Report as a
preliminary document; passed and adopted Resolution 85-72 as the Resolution of
Intention to formulate the Tustin Landscape and Lighting District; and, set July
15, 1985 as the date for the public hearing to discuss the District.
DISCUSSION:
The public hearing for the formulation of the Tustin Landscape and Lighting
District was duly noticed pursuant to the Landscape and Lighting Act of 1972.
If, at the conclusion of this public hearing, Council desires to formulate the
Tustin Landscape and Lighting District, Council will need to pass and adopt a
Resolution ordering improvements and the ~formation of the Tustin Landscape and
Lighting District and confirm the Assessment and diagram. If this is the course
of action desired by Council, a Resolution for same has been prepared and attached
for Council's convenience.
Should Council pass and adopt the Resolution of Formation, the confirmed
assessment roll will be filed with the County Auditor-Controller by the deadline
of August 12, 1985.

RESOLUTION NO. 85-75
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ORANGE COUNTY, CALIFORNIA, ORDERING IMPROVEMENTS
AND THE FORMATION OF THE TUSTIN LANDSCAPE AND LIGHTING
DISTRICT, AND CONFIRMING THE ASSESMENT AND DIAGRAM
WHEREAS, the City Council of the City of Tustin, California,
has adopted Resolution No. 85-43, initiating proceedings for the formation of
an Assessment District pursuant to the Landscape and Lighting Act of 1972
(Part 2 of Division 15 of the Streets and Highways Code of California
hereinafter referred to as "the Code"), for the maintenance and operation of
street lighting and landscaping; and
WHEREAS, the City Engineer has prepared and filed with the
City Clerk his report (the "Report") containing the matters specified in
Section 22567 of the Code; and
and
WHEREAS, the City Council has approved the Report as filed;
WHEREAS, the City Council heretofore by Resolution of
Intention No. 85-72 adopted on July 1, 1985, declared its intention to order
the formation of an assessment district designated "Tustin Landscape and
Lighting District" for the purpose of maintaining, and operating street
ighting and landscaping, as described in said Resolution of Intention; and
WHEREAS, the City Council, in and by said Resolution of
Intention, fixed Monday, July 15, 1985, at 7:00 p.m. before the City Council in
the Council Chambers at 300 Centennial Way, Tustin, California, as the time and
)lace for a hearing on the question of the formation of the assessment district
and the levy of the proposed assessment, and provided for notice of said

hearing; and
WHEREAS, the City Clerk has set forth the time and manner of
the compliance with the requirements for posting and mailing set forth in
Section 22588 of the Code; and the City Council hereby finds that the
Resolution of Intention has been posted and mailed in the time, form and manner
required by law; and
WHEREAS, said hearing was duly opened and held by the City
Council at the time and place for the hearing; and
WHEREAS, the Auditor-Controller of the County of Orange has
authorized and consented to the conclusion of said hearings and the adoption of
this Resolution confirming the. Diagram and assessment on a date after July 1,
1985, but prior to August 12, 1985; and
WHEREAS, no written protests or objections were delivered to
the City Clerk prior to the conclusion of the hearing; and
WHEREAS, no verbal protests or objections were made at the
hearing of July 15, 1985; and
WHEREAS, the public interest and convenience require the
maintenance, and operation of street lighting and landscaping within the
proposed assessment district; and
WHEREAS, all the territory within said assessment district
will be benefitted by the improvements described in the Resolution of
Intention.

NOW, THEREFORE, the City Council of the City of Tustin
resolves as follows:
SECTION 1: The foregoing recitals are true and correct and
the City Council so finds and determines.
SECTION 2: Tustin Landscape and Lighting District is hereby
formed and the improvements, consisting of the maintenance, and operation of
street lights and landscapes in said assessment district, as set forth in the
Report, a copy of which is on file in the Office of the City Clerk, are ordered
to be undertaken. The exterior boundaries of said district shall be Browning
Avenue, Irvine Boulevard, Myford Road, and I-5 Freeway within the City of
Tustin. Pursuant to Section 22508 of the Code, reflected on the Diagram on
file with the County Assessor Of Orange County for a full and detailed
description thereof.
SECTION 3: The Diagram and assessment for fiscal year
1985-86, as set forth in the Report, copies of which are on file in the Office
of the City Clerk, are hereby confirmed.
SECTION 4: Passage of this Resolution shall constitute a levy
of an assessment for the fiscal year referred to in the assessment confirmed
herein. A copy of the assessment which specifies the amounts levied is
attached hereto and made a part of this Resolution as Exhibit "A".
SECTION 5: Pursuant to law, including Article i of Chapter 4
of Part 2 of Division 15 of the Code, the City Clerk shall file a certified
copy of this Resolution and the diagram and the assessment confirmed by this
Resolution, or a certified copy thereof, with the County Auditor of Orange
County.
