On July 12, 1985, staff received letters from two divisions of the Southern California Gas Company (copies attached) which request that the public hearing be continued until such time satisfactory arrangements can be made with respect to a permanent easement for their facilities. Staff has consulted with the City Attorney's office and we feel that Paragraph 2 and Exhibit A-2 and A-3 of the Resolution should be amended prior to adoption in order to satisfy the concerns of the Gas Company. The revised paragraph 2 provides a more complete description of the area to be reserved for utility easements and names the known utilities at this time. Exhibits A-2 and A-3 are revised to indicate reservation of the entire vacated area for utility easements rather than the northerly half. Attached, is the new amended Resolution and revised Exhibit A-2 and A-3. The a, City Council finds and determines: The City Council duly adopted its Resolution No. 85-59, declaring its intention to vacate and abandon a portion of Moulton Parkway, shown on Exhibit "A" through "D" attached hereto and incorporated herein by this reference, and fixing a time and place of public hearing thereon. b. Said Resolution has been duly published according to law, and c. Said notices of said hearing have been posted as required by law, and d® ee A public hearing has been duly called, noticed and held according to law, and all persons interested in or objecting to the proposed vacation and abandonment appearing at said hearing were heard. Said portion of streets are not necessary for present or prospective public street purposes, except for public utilities. That the Planning Agency by adoption of Resolution No. 2244, dated June 10, 1985, has determined that the subject property should be declared excess to the City's needs and disposed of for private development and flood control use. g. Categorical exemption from EIR requirements. 2.
