RESOLUTION NO. 85-80
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, WAIVING THE REQUIREMENT OF A TEN FOOT IRREVOCABLE
OFFER OF DEDICATION ALONG RED HILL AVENUE FOR THE PROJECT
APPROVED BY USE PERMIT 85-10 AT 13891 RED HILL AVENUE.
The City Council does hereby resolve as follows;
A. That a proper application (Use Permit No. 85-10) has been filed
by Mr. Dick Meyers on behalf of Shell Oil Corporation requesting
authorization to convert and expand a lube bay to a car wash and
a sales area to a cashier's booth and mini market and {he
construction of a 6' X 12' storage area.

That a public hearing was duly called, noticed and held by the
Planning Commission of the City of Tustin, on June 24, 1985 on
said application.

The Planning Commission approved Use Permit 85-10 by the
adoption of Resolution No. 2246 which authorized the
installation of a 167 square foot mini market and cashier's
booth within the existing sales area at 13872 Red Hill Avenue as
applied for, subject to the following conditions:
1. Any missing or damaged public improvements shall be
installed or replaced.
2. Annexation to Street Lighting District No. 1.
3. Installation of marbelite street lights shall be provided
with underground conduit as required.
4. Provide an irrevocable offer of dedication of ten {10')
feet along Red Hill Avenue and an appropriate corner cut
off to accomodate curb return radius.
Construction of a handicap ramp at the curb return per City
Standard Drawing Number 124 A & B will be required.
Final development plans shall require the review and
approval of the Community Development Department.
7. The provisions of the Use Permit do not cover the
authorization for the sale of alcoholic beverages.
Prior to conversion to the mini-market and car wash, any
signs or face changes and their appropriate plans as
authorized by Sign Ordinance No. 684, shall be approved and
permitted prior to their installation.

Approval of Use Permit 85-10 is contingent upon the
applicant signing and returning as "Agrement to Conditions
Imposed" form as established by the director of Community
Development.
On June 14, 1985 the applicant filed an appeal of the
Conditions of Approval for Use Permit 85-10 to the Tustin City
Council.
E. A public hearing before the City Council was duly called,
noticed and held on said appeal.
II.
The City Council hereby upholds Planning Commission approval of Use
Permit 85-10 with the following amendment:
Condition No. II. A. 4 of Planning Commission Resolution Number
2246 pertaining to an irreiocable offer of dedication of ten
(10') feet along Red Hill Avenue is hereby deleted.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council on the
day of , 1985.
