(FILE #2695A) RECOMMENDATION: That the Tustin City Council, at their meeting of August 5, 1985, deny the request for removal of two street trees at 14132 Charloma Drive. BACKGROUND: Staff has received a request from Mr. A1Mannarelli of 14132 Charloma Dr. for the City to remove two parkway trees. {Copy attached). The two trees are Tristania Conferta (Brisbane Box) and are on the City's approved tree list and are shown on the attached photos. Current City Policy provides for the following: Case I - Problem trees causing current or future damage to curb and sidewalk will be removed by the City and replaced with a fifteen gallon size tree at City expense subject to availability of funds. Case II - Undesirable tree {City approved) due to extensive litter or other problems will be removed by the City and replacement cost (tree, labor, materials) at the expense of the adjacent property owner. Case III - Unapproved tree (not of a problem or desirable species) will be removed by the City and replacement cost (tree, labor, materials) at the expense of the adjacent property owner. DISCUSSION: Mr. Mannarelli indicates the trees are messy and lose leaves and bark on a daily basis. Additionally, he states the tree is raising the sidewalk again which has been previously replaced twice. Staff has indicated that the sidewalk has been replaced in recent years but for reasons other than the trees. These trees are currently planted in a.six (6) foot clear area between the curb and sidewalk as shown in the attached photos. Letters have been sent to the neighborhood with two responses being received. A copy of these responses are attached for information. Both responses are against the removal of these two trees. REQUEST FOR TREE REMOVAL JULY 22, 1985 PAGE 2 Mr. Mannarelli has requested that the two trees be removed at no cost to him and that the City replace the two trees with a different species at no cost to himself, or not replace them at all. This request for tree removal falls under Case II of current City Policy, wherein removal is at City cost and replacement cost is the obligation of the property owner. Replacement cost for these trees is estimated at $85.00 per tree. In the event the trees are removed under Case II of the current City Policy, it is suggested that a deposit in the amount of $170.00 be with the City prior to the start of any removals. Staff recommends against the removal of these two street tFees based upon reasons stated by the resident.
