RAILROAD CROSSING RECOMMENDATION: That the Tustin City Council, at their meeting of August 19, 1985, adopt a minute order authorizing the Mayor to execute Program Supplement No. 5 to local agency (Tustin)/State Agreement No. 07-5271 and authorize a supplemental budget appropriation for F.Y. '85-'86 in the amount of $5,150.00. BACKGROUND: The City of Santa Ana has been acting as lead agency for Tustin and the A.T. & S.F. Railroad for the installation of automatic gates to provide improved protective/warning devices for the subject railroad crossing. This project has been under processing for the last 4-5 years and had previously been included within Tustin's Capital Improvement Budget on a year to year basis. Due to no activity on the project, it was dropped from the City's program two years ago. Apparently, Federal Aid Urban (F.A.U.) funding is now available for the project and the project is now ready to be implemented. It is proposed that Federal funding {F.A.U.) will finance 90% of the project while the local agencies, Santa Ana and Tustin will provide the matching funds in the amount of 10%. DISCUSSION: The attached document is Program Supplement No. 5 to the Tustin/State Master Agreement No. 07-5271. The original Master Agreement was approved by both agencies in October, 1979. Each time a new project is approved by CalTrans and the Federal Highway Works Administration (F.H.W.A.), a program supplement must be executed by both agencies. This type of program supplement has been previously executed by the City for previous projects which have been completed. This program supplement provides for the following: e Cost of maintenance of the crossing shall be as allocated by the Public Utilities Commission. All required signing and marking at railroad crossing to be completed in accordance with the requirements of M.U.T.C.D. AUGUST 7, 1985 PAGE 2 ® Limitation of Federal funds in the amount of $92,700.00, any excess to be borne by local agencies. 4. City reaffirms the "nondiscrimination assurances" contained in the aforementioned Master Agreement. 5. Funding distribution as follows: City of City of Total FAU Santa Aha Tustin Cost Share Share Share $103,000 (90%) $92,700 (5%) $5,150 (5%) $5,150 Participation in this project will require a supplemental budget appropriation in the amount of $5,150.00 for the 1985-86 budget year. The execution of this Program Supplement No. 5 will require the adoption of a minute order authorizing said execution.
