RECO~ENDEO ACTION:
Staff recommends approval of Zone Change 85-6:
1. Have first reading of Ordtnange by title only;
2. Introduce Ordinance No. 944.
BACKGROUND:
Earlier this year, staff conducted a survey of all properties in the city that
required either a General Plan Amendment or Zone Change in order that both
documents would be in conformance, a requirement of State law. The City Council
directed staff to start proceedings and bring these changes before the Planntng
Commission and City Council for implementation. To date, the General Plan
Amendments have been completed and the Zone Changes have been before the
Commission. Each Zone Change has been recommended for change by the Commission
to the Council by a vote of five ayes and zero noes.
This Zone Change represents the first to be brought before the City Council.
The remaining Zone Changes will be brought incrementally before the Council
until all are completed.

DISCUSSION:
The church at this location has a General Plan designation that reflects its
non-profit status: Public and Institutional (P&I). The church was annexed into
the city with an R-3 Multiple Family Zone which does allow churches with a
Conditional Use Permit. Although the zone does allow for churches, the General
Plan and zoning must be in conformance, and the Public and Institutional
designation was created for these types of uses. Staff recommends a Zone Change
to Public and Institutional (P&I).

AN ORDINANCE OV THE CITY COUNCIL OV THE CITY OV TUSTIN,
REZONING 12821 NEWPORT AVENUE FROM R-3 (MULTIPLE VAMILY)
DISTRICT TO PUBLIC AND INSTITUTIONAL DISTRICT (P&I), AS
SHOWN IN EXHIBIT "A"
The City Council of the city of Tustin does hereby ordain as follows:
I. The City Council finds and determines as follows:
That a proper application, (Zone Change No. 85-6) has been filed
by the city of Tustin to change the zone for 12821 Newport
Avenue from R-3 (Multiple Family District) to Public and
Institutional District (P&I), as shown in Exhibit "A".
B. That a public hearing was duly called, noticed and held on said
application.
C. That a zone change should be granted for the following reasons:
That the proposed change would bring the Tusttn Area
General Plan in conformance with the Zoning Map.
That the proposed change would not be detrimental to the
public health, safety, and welfare of the surrounding
property owners.
Development of subject property shall be in accordance with the
policies adopted by the City Council; Uniform Building Codes as
administered by the Building Official; Uniform Fire Code as
administered by the Orange County Fire Marshal; and street
improvement requirements as administered by the City Engineer.
In accordance with the requirements of the California
Environmental Quality Act Guidelines, the subject project will
not have a significant impact on the environment and therefore a
Negative Declaration is recommended to the City Council.
That the Planning Commission adopted Resolution No. 2231,
recommending to the City Council that they adopt Zone Change
85-6.

II.
The City Council hereby approves Zone Change No. 85-6, from R-3
{Multiple Family District) to Public and Institutional District (P&I)
for 12821 Newport Avenue, as shown in Exhibit "A".

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN,
RECOMMENDING REZONING OF 12821 NEWPORT AVENUE FROM R-3 (MULTIPLE
FAMILY) DISTRICT TO PUBLIC AND INSTI.TUTIONAL DISTRICT (P&I), AS
SHOWN IN EXHIBIT "A".
The Planning Commission of the City of Tustin does hereby resolve as
follows:
The Planning Commission finds and determines as follows:
