BACKGROUND AND DISCUSSION: The City Council and Planntng Commission previously approved Use Permtt 85-9 allowing Carver Development Company to construct a 90,000 square foot retail center and 46,000 square foot office complex along Newport Avenue from E1Camino Real to the Main Street intersection. The property in question consists of etght separate parcels which must be consolidated into a total of three parcels to allow this development to proceed. In compliance with the Use Permit requirement to consolidate parcels, the subject parcel map 85-246 was submitted by Carver Development and approved by the Planning Commission on August 12, 1985. However, the applicant's representative Mr. Start Cole requested relief from condition II. 1. d. in the attached resolution 85-88 which concerns the required construction of an acceleration lane on Newport Avenue southerly from the Main Street intersection. This condition is.specifically required in the parcel map process since at the time of Use Permit and precise site plan dimensions and the right of way had not been engineered. Now that the City Engineer has reviewed the subject map, the precise cross section design of Newport Avenue and the acceleration lane can be determined. Upon discussion by the Planning Commission, it was determined that this matter is a policy question for the City Council since it is specifically engineering oriented and not a land use issue. CITY COUNCIL REPORT TPM 85-246 page two The Council at its August 19, 1985 meeting continued consideration of the subject map at the applicant's request due to their inability to attend that meeting. The map is now scheduled for consideration on Council's September 3rd agenda. The City Engineer and contract Traffic Engineer will be in attendance at the Council meeting to both address the request for acceleration lane construction and to answer any questions that Council might raise. The City Council finds and determines as follows: A. That Tentative Parcel Map No. 85-246 was submitted to the City Council pursuant to Ordinance 847 by Psomas and Associates on behalf' of Carver Development requesting authorization to. consolidate 8 lots into 3 lots for the properties known as portions of Blocks 20, 21, 33 and 34 recorded in Book 4, Pages 218 and 219 of Miscellaneous Records in the office of the County Recorder of Los Angeles County and portions of Block "A" of the S. Tustin Tract as recorded in Book 1, page g9 of miscellaneous maps, records of Orange County and a portion of Laguna Road (abandoned) now known as E1Camtno Real. B. That said map is in conformance with the Tustin Area General Plan. C. That a Negative Declaration was previously approved for the project. The City Council hereby approves Tentative Parcel Map No. 85-246 subject to the following ~ondittons:' 1. Following right-of-way dedications shall be required for street and bike trail purposes: a. Main St. - 10 ft. dedication to accommodate a fifty foot wide half street on the southerly side. b. Newport Ave. - 17 ft. dedication to accommodate a fifty foot wide half street on the westerly side and a ten foot wide bike trail. c. Dedication of corner cut-offs/radii at each curb return to provide city standard curb return radii at all intersections. d. Additional right-of-way along Newport Ave. southerly of Main St. to provide an acceleration lane and enlargement of the curb return radius at Main St. and Newport Ave. 2. Construction of public improvements along the Main St., Newport Ave. and Sixth St. frontages. These improvements will include but not be limited to the following: a. Street paving b. Traffic signal installation {50%) at Sixth/Newport f. Driveway construction g. Storm drain extensions and facilities as required h. Marbelite street lights with underground electrical feed i. Domestic water and fire service systems J. Connection of all building structures to sanitary sewer system k. Street trees as required 3. Submission of a final grading plan for review and approval. 4. Enlargement of curb return radius at Main St. and Newport Ave.. (southwesterly corner). 5. Maintenance of all landscaping located within public: right-of-way. 6. Whenever a five ($) foot sidewalk is utilized adjacent to the curb as proposed, the remaining three (3) feet of right-of-way. shall be maintained for street lights, signing, fire hydrants and other public utilities. 7. The sidewalk on Sixth St. shall be a full width sidewalk (10 feet) for commercial projects. · 8. Payment of following fees at the time a building permit is issued: a. County Sanitation District No. 7 sewer connection fee based upon $50.00/1,000 sq. ft. of building area and any front footage fee for connection to a County Sanitation District sewer (if required). b. East Orange County Water District fee. Contact Earl Rowenhorst of Tustin Water Service for fee amounts. g. Water improvement plans shall be approved by the Fire Chief for fire protection including distribution of fire hydrants, design and adequacy.
