Have first reading of Ordinance by title only; 2. Introduce Ordinance No. 946. BACKGROUND: Earlier this year, staff conducted a survey of all properties in the city that required either a General Plan Amendment or Zone Change in order that both documents would be in conformance, a requirement of State law. The City Council directed staff to start proceedings and bring these changes before the Planning Commission and City Council for implementation. To date, the General Plan Amendments have been completed and the Zone Changes have been before the Commission. Each Zone Change has been recommended for change by the Commission to the Council by a vote of five ayes and zero noes. This is the third zone change of a total of six. The remaining zone changes will be brought incrementally to the City Council. City Council Zone Change 85-9 page two DISCUSSION: The subject site has a General Plan land use designation of Public and Institutional and is owned by the Tustin Unified School District. In' conjunction with the school district, the City has constructed tennis courts on a portion of the site, with the remaining area as vacant land. The current zoning districts for the site are Planned Manufacturing {PM) and Manufacturing {M), both industrial zones. In order to reflect the land use designation and tax exempt status of the property owners, the site requires a zone change to Public and Institutional (P&I). Staff recommends a zone change to Public~ and Institutional {P&I). The City Council of the City of Tustin does hereby ordain as follows: I. The City Council finds and determines as follows: That a proper application, (Zone Change No. 85-9) has been filed by the City of Tustin to change the zone for the southerly terminus of Carfax Avenue, westerly of School Road from Planned Manufacturing and Manufacturing District (PM&M) to the Public and Institutional District (P&I), as shown in Exhibit "A". That a public hearing was duly called, noticed and held on said application. C. That a zone change should be granted for the following reasons: That the proposed change would bring the Tustin Area General Plan in-conformance with the Zoning Map. That the proposed change would not be detrimental to the public health, safety, and welfare of the surrounding property owners. Development of subject property shall be in accordance with the policies adopted by the City Council; Uniform Building Codes as administered by the Building Official; Uniform Fire Code as administered by the Orange County Fire Marshal; and street improvement requirements as administered by the City Engineer. In accordance with the requirements of the California Environmental Quality Act Guidelines, the subject project will not have a significant impact on the environment and therefore a Negative Declaration is hereby adopted. The Planning Commission of the City of Tustin does hereby resolve as follows: II.
