AUTHORIZATION TO ADVERTISE FOR BIDS FOR LANDSCAPE MAINTENANCE PROGRAM
- CIVIC CENTER COMPLEX
RECOMMENDATION:
Request the Tustin City Council, at their regular meeting of September 16, 1985,
to authorize the City Clerk to advertise for bids to contract for Landscape
Maintenance - Civic Center Complex.
BACKGROUND:
In the past, landscape maintenance at the Civic Center Complex has been
performed by in-house staff. Increased work loads now prohibit City staff from
providing landscape maintenance at a desirable level. Staff feels the most
feasible manner to provide the level of service to maintain aesthetics at the
Civic Center Complex is to contract for the services. The engineer's estimate
for this contract is $37,500.00.

RESOLUTION NO. 85-97
A RESOLUTION OF THE TUSTIN CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS
FOR THE CITY LANDSCAPE MAINTENANCE PROGRAM - CIVIC CENTER
COMPLEX AND DIRECTING THE CITY CLERK TO ADVERTISE FOR
BIDS.
WHEREAS, it is the intention of the City Council of the City of Tustin,
California to contract the landscape maintenance in the Civic Center Complex,
and;
WHEREAS, the City Engineer has presented plans and specifications for
said work;
NOW THEREFORE, BE IT RESOLVED that the plans and specifications
presented by the City Engineer be and are hereby approved as the plans and
specifications for:
THE CITY OF TUSTIN LANDSCAPE MAINTENANCE PROGRAM -
CIVIC CENTER COMPLEX
BE IT FURTHER RESOLVED that the Secretary is hereby authorized and
directed to advertise as required by law for the receipt of sealed bids or
proposals for the doing of the work specified in the aforesaid plans and
specifications which said advertisement shall be substantially in the
following words and figures to-wit:
"NOTICE TO CONTRACTORS"
SEALED PROPOSALS will be received at the office of the Tustin
City Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California, until
10:00 A.M. on the 11th day of October, 1985, at which time they will be
publicly opened and read, for performing work as follows:

SCHEDULE OF WORK ITEMS
The total square feet of landscaping turf and ground cover is approximately
125,503 square feet.
1. All parking lots (public and employee) are to be cleaned once per week
at a time when lots are not in use.
2. All landscaping is to be free of litter/debris and weeds, maintaining
a manicured apperance at all times.
3. Turf is to be mowed once per week during the Fall and Winter season,
twice per week in the flush growing seasons of Spring and Summer.
All landscaped areas are to be fertilized quarterly with 10-6-8
fertilizer or equivalent at the rate of five pounds (5 lbs.)/thousand
square feet.
5. All trees, shrubs, ground cover and turf are to be treated with
insecticide as needed to keep landscaping free from insects.
6. Fungicides applied as needed to keep all plants and turf free from
mildew and fungus.
7. Appropriate watering will be maintained to insure healthy growth,
while preventing damage to landscaping.
8. Repair and maintenance of all sprinkler systems to insure 'proper
working order.
9. Shrubs, trees, ground cover and turf must be trimmed from walkways to
eliminate any potential hazard to pedestrian traffic.
10.
All trees and shrubs around the parking lots to be trimmed so as to
avoid interference with vehicular and/or pedestrian traffic and
security lights.
11. All walkways are to be free of any debris, grass clippings or other
objects that pose a potential hazard to pedestrian traffic.

The Wishing Well at the corner of Main and Centennial is to be cleaned
weekly. The pump is to be maintained in good working order, filter to
be changed as needed, and proper chemicals added to the water to
maintain a ph factor that will prohibit the growth of algae.

The foregoing is being given as a basis for the comparison of bids, and
the City Council does not, expressly or by implication, agree that the
actual amount of work will correspond therewith, but reserves the right to
increase or decrease the amount of any class or portion of the work or to
omit portions of the work as may be deemed necessary or advisable by the
Engineer.
The City Council has budgeted a fixed amount for the work encompassed
by these plans and specifications. In the event that the low bid exceeds
or is less than the budgeted amount, the City reserves the right to delete
or add projects to the contract as necessary to stay within the budgeted
amount. The provisions of Section 4-103B of the Standard Specifications
(increased or decreased quantities) shall not apply to this contract.
Plans, specifications and proposal forms to be used for bidding on this
project can only be obtained by prospective bidders at the office of the
City Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California,
92680, upon payment of $5.00 per set, which amount shall be
non-refundable.
Plans and specifications will only be mailed out upon payment of
$7.00 per set, which amount shall be non-refundable.
In conformance with Section 37931 of the Government Code, all bids
shall be presented under sealed cover on the proposal form provided and
accompanied by one of the following forms of bidder's security:
a. Cash
b. Cashier's check made payable to the City of Tustin
c. Certified check made payable to the City of Tustin
d. Bidder's bond executed by an accredited surety insurer, made
payable to the City of Tustin.
The security shall be in an amount equal to at least ten percent
(10%) of the amount of the bid. A bid shall not be considered unless one
of the forms of bidder's security is enclosed therewith.
A Security Bond for payment of labor and materials will be required
in the amount of fifty percent (50%) of the estimated total contract price
and a Faithful Performance Bond in the amount of one hundred percent
(100%) of the estimated total contract price in the form attached to the
contract documents. Said bonds shall be issued by a Surety Company rated
Grade A or better and Class IX or better by the latest edition of Best's
Key Rating Guide.
The City of Tustin reserves the right to reject any or all bids,
and/or waive any informality on a bid. No bidder may withdraw his bid for
a period of thirty (30) days after the date set for the opening thereof.
The contract will be awarded to the lowest qualified bidder.

Provisions of the State Contract Act are not applicable, and
prospective bidders will not be required to be prequalified.
All work to be done under the direct supervision of the City Engineer
or Maintenance Superintendent, City of Tustin.
All work to be paid for at the prices bid from appropriated monies.
The City of Tustin has obtained from the Director of Industrial
Relations the general prevailing rate of per diem wages and the general
prevailing rate for legal holiday and overtime work in the locality in which
the work is to be performed for each craft or type of work needed and a copy
of the same is on file in the office of the City Engineer.
Not less than said prevailing rates shall be paid to workers employed on
this public works contract as required by Labor Code Sections 1771 and 1774
of the State of California.
