RECOI~IENDATION: M. O. - That Ordinance No. 946 have second reading by title only. M. O. - That Ordinance No. 946 be passed and adopted. (Roll Call Vote) 1 2 3 4 5 6 7 8~ 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. 946 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, REZONING THE SOUTHERLY TERMINUS OF CARFAX AVENUE, WESTERLY OF SCHOOL ROAD FROM PLANNED MANUFACTURING AND MANUFATURING DISTRICT (PM&M) TO PUBLIC AND INSTITUTIONAL DISTRICT (P&I), AS SHOWN IN EXHIBIT "A". The City Council of the City of Tustin does hereby ordain as follows: I. The City Council finds and determines as follows: That a proper application, (Zone Change No. 85-9) has been filed by the City of Tustin to change the zone for the southerly terminus of Carfax Avenue, westerly of School Road from Planned Manufacturing and Manufacturing District (PM&M) to the Public and Institutional District (P&I), as shown in Exhibit "A". B. That a public hearing was duly called, noticed and held on said application. C. That a zone change should be granted for the following reasons: 1. That the proposed change would bring the Tustin Area General Plan in conformance with the Zoning Map. That the proposed change would not be detrimental to the public health, safety, and welfare of the surrounding property owners. Development of subject property shall be in accordance with the policies adopted by the City Council; Uniform Building Codes as administered by the Building Official; Uniform Fire Code as administered by the Orange County Fire Marshal; and street improvement requirements as administered by the City Engineer. In accordance with the requirements of the California Environmental Quality Act Guidelines, the subject project will not have a significant impact on the environment and therefore a Negative Declaration is hereby adopted. That the Planning Commission adopted Resolution No. 2234, recommending approval of Zone Change 85-9 to the City Council. 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 2,~ 25 26 27 28 Ordinance No. 946 page two II. The City Council hereby adopts Zone Change No. 85-9, from Planned Manufacturing and Manufacturing District (PM&M) to Public and Institutional District (P&I) for the southerly terminus of Carfax Avenue, westerly of School Road as shown in Exhibit "A".
