RECOMMENDATION:
That the Tustin Community Redevelopment Agency, at their meeting of October 10,
1985, approve the Professional Services Agreement naming A.S.L. Consulting
Engineers as the consultant for the Newport Avenue Extension Precise Alignment
subject to final review by the City Attorney's office.
BACKGROUND:
At the August 5, 1985 Agency meeting, staff was authorized to solicit proposals
for consultant services for preparation of a precise horizontal and vertical
alignment for the extension of Newport Avenue based upon Alternative 3 of the
Austin-Foust South Newport-Edinger Circulation Study.
DISCUSSION:
Staff has received proposals from five consultant firms as follows:
A.S.L. Consulting Engineers, Santa Ana ....................... $22,700.00
J.P. Kapp and Associates, Inc., Tustin ....................... 34,840.00
Madole and Associates, Santa Ana ............................. 43,785.00
Wilson-Sheehan Associates, Brea .............................. 47,700.00
B.S.I. Consultants, Inc., Santa Ana .......................... 51,685.00
All of the above firms are qualified for this work and had indicated that they
could meet the sixty calendar day work schedule.
Staff has selected the firm of A.S.L. Consulting Engineers to perform said work in
the amount of $22,700.00. An amount of $40,000.00 had been previously budgeted
for this project.
The attached Professional Services Agreement designates the firm A.S.L.
Consulting Engineer's to perform said work and requires approval and execution by
the Agency.

PROFESSIONAL SERVICES A~EEMEHT
THIS AGREEMENT, made and entered into this __.day of , 1985,
by and between TUSTIN COMMUNITY REDEVELOPMENT AGENCY, (hereinafter referred to as
"Agency"); and A.S.L. CONSULTING ENGINEERS, 1201 East Warner Avenue, Santa Aha,
California 91705-5456, (hereinafter "Consultant").
WITNESSE1]4:
WHEREAS, Agency desires to employ Consultant to furnish the necessary
engineering services for the precise horizontal and vertical alignments for the
southerly extension of ~ewport Avenue to its intersect~on with Edinger Street,
which shall hereinafter be referred to as the "Project"; and
WHEREAS, Consultant is qualified to provide the necessary services in
connection with said project and has agreed to provide the necessary consulting
services; and
~HEREAS, Consultant has submitted to Agency a proposal dated September, 16,
1985, a copy of which is attached hereto marked Exhibit "A", and is by this
reference incorporated herein as though set forth in full hereat ("the Proposal").
NOW, THEREFORE, Agency agrees to employ and does hereby employ Consultant to
provide the necessary engi~eering services for the project, and ~gency and
Consultant for the consideration hereinafter set forth, agree as follows:
Section 1: Scope of Consultant's Services. Consultant agrees to pe~'form for
the Agency the engineering services for the project. These services shall incluCe
all of the services to be performed in the manner described in the Proposal, a
copy of which is attached hereto and marked as Exhibit "A".
Section 2: Time for Completion. it is hereby understood and mutually agreed
that the time for co~,pletion of said engineering services shall be sixty !60)
calendar days. The sixty (60) calendar Gays shall co~mence on September 30, 1985.
Consultant agrees that it ~hall prosecute regularly and diligently the work of
this ~gree~nt according to reasonable schedules established by Agency for the
various items of .ork described.

C,jnsu!tant agrees that it shall prosecute regularly and diligently the work of
this Agreement according to reasonable schedules established by Agency for the
various items of work described. Consultant shall not be accountable for delays
in the progress of its work caused by any condition beyond its control and without
the fault or negligence of Consultant.
Section 3: Com~:nsation. The compensation fo be paid ~Jnder this Agreement
shall be as follows:
A. Consultant's labor fees (including staff t~m_, clerical, report
production, travel) for Phase I'and Phase II shall not exceed $22,700.00 without
specific authorization by the Agency.
B. Compensation to Consultant for services performed in accordance with
its proposal, attached as Exhibit 'A', and shall not exceed $22,700.00.
Consultant shall submit monthly invoices based on the services
provided during the preceedlng month, and Agency shall pay Consultant within
thirty (30) days of receipt of said invoice with the total of all pay~,ents not to
exceed the above stated fi~d fee amount without approval of Agency. Said monthly
invoices shall include an itemization of the time spent and the fees, costs and
charges accrued to date and a descrlF, t~on of services performed during the billing
period.
I~ t?~e eYent of authorizotion, in writing by Agency, of changes from
the scope of services as described in Exhibit 'A' or for other written permission
a~Jthorizing additional work not conteF~p!ated herein, additional ccmpensatlon shall
5e allowed for such extra work based ~pon the authorized payment schedule for

Section a: Miscellaneous Provisions.
A. Ag,=,~]y and C.~nsultant fJrt!~er agree to the following conditions:
(1) Agency, by notifying Consultant in writing, shall have the
right to terminate any or all of the services and work covered by this Agreement
~t amy time.

(2) Consultant agrees that it shall proceed immediately and
diligently to perform the services provided for in this Agreement upon receipt of
notice from A~ency to proceed therewith.
(3) The terms and provisions of this A§reement shall extend to and
be binding upon and inure to the benefit of heirs~ executors, administrators,
successors and assigns of the respective parties thereto.
(4) Consultant shall perform the services hereun~er as an
independent contractor and under no circumstances or conditions shall Consultant
and any of its agents, servants and employees, be considered as an employee or
agent of the Agency.
(5) Consultant shall perform all services required under this
Agreement in a careful, diligent, professional manner,,and shall be responsible
for all errors and omissions for services performed by Consultant under the terms
of this A§reement. Consultant, as a material part of the comsideratlon of this
Agreement, hereby waives, on its behalf and on behalf of all others claiming
through Consultant, all claims and demands against Agency, its agents, employees,
successors and assigns, for all loss, damage, injury, sickness or death of any
person resulting from the negligent performance of this Agreement, and a~rees to
indemnify, defend and hold Agency, its agents, employees, successors and assi§ns,
harmless from any loss, damage, injury, sickness, death, or other claim made by
other ~ersons and from all costs, expenses and charges arising tY:arefrom.
Consultant shall maintain in full force and effect during the term of this
Agreement, its existiog policies of insurance for which certificates of insurance
have heretofore been delivered to Agency.
(6) Consultant shall carry and pay for such compensation insurance
as is necessary to fully protect Consultant and its employees under California
Worker's Compensation Insurance, and safety laws, to relieve Agency from all
responsibility u~der said laws in ccqnectlon with the performance of this
A§ree[~ent, and upon the execution of this Agreement, to file with ~gency a
certificate certifying to said protection.
(7) Consultant certifies that there shall be no discrimination
against any employee who is employed in the work covered by this Agreement, or
against any application for such employment, because of race, rellg~on, color,
sex, or natlooal origin, including but not limited to, the following:
(i) Employment, upgrading, demotion or transfer,
recruitment or recruitment advertising, lay-off or termination, rates
of pay or other forms of compensation, and selection for training,
including apprenticeship.
IN WITNESS WHEREOF, this Agreement was executed by the parties on the day and
year first above written.

ASL Consulting Engineers wishes to thank you for providing us
with the opportunity to propose on this prpject. We have
examined the proposed alignment in the field and discussed
the City's desires for the project with Mr. Don Lamm. Based
on the information gathered during these efforts, we believe
we have a clear view of the intended product for this pro-
ject.
The critical aspects of this project will be for the engineer
to determine whether the overcrossing can be accomplished
using acceptable grades and horizontal and vertical curves.
Night of way will also be important. The proposed alignment
(Alternate 3) could affect up to 11 parcels including the
55 Freeway on/off ramps at Edinger Street. The disposition
of the railroad spur will be another matter that will have
to be solved by the consultant.
ASL has done numerous precise alignment designs in the Orange
County area. Some of our more recent projects include the
precise alignment for Padua Avenue in the City of Claremont;
the alignment of Pacific Coast Highway between Jamboree ~oad
and Backbay Drive including an overcrossing at Jamboree Road
for the City of Newport Beach; and Main Street and Bonita
Canyon Road in the City of Irvine. Together these projects
encompass all of the tasks required by your Newport Avenue
project.

To work on the precise alignment design and right of way
engineering, we have assembled a project team comprised of
.individuals who are experts in their field. Members of our
staff will perform all of the horizontal and vertical align-
ment engineering as well as the right of way descriptions
and plats. Aerial topographic mapping will be accomplished
by Pictorial Services, Inc. with ASL survey crews handling
the ground work. Mr. Douglas J. Reinhart will be Principal
in Charge and Mr. William E. Bennett the Project Manager.
We have included copies of their resumes together with those
for other key staff members who will work.on this project.
We can have the precise alignment (Phase I) completed prior
to your 60-day completion date. However, if it is the City's
intention to not proceed with Phase II until the various
agencies involved have had the opportunity to review and
approve the alignment, then Phase II could be accomplished
within that time frame. The review period for Caltrans
alone will be in excess of 8 weeks. Disregarding the review
periods though, we can have both phases completed within
the 60-day period.

INFORMATIONAL NOTES
(1) The conceptual alignment, as shown on the Austin-Foust Exhibit Alternative 3
(overcrossing), is only conceptual. The Agency will entertain variations of
this conceptual alignment to provide improved roadway design criteria. These
variations may include but not be limited to'the following:
a. Commencing the realignment at a point northerly from that shown on the
Austin-Foust exhibit.
b. Easterly shift in realignment resulting in an encroachment within the
Sycamore Gardens development.
(2) Final precise alignment plans shall be on 24" X 36" mylar sheets and drafted
at a minimum scale of 1' - 40 ft. horizontally and 1' = 4 ft. vertically.
(3) Individual parcel right-of-way maps shall be prepared on 8 1/2' X 14' or B
1/2' X 11' sheets suitable for attachment as exhibits to right-of-way
documents.
(4) The time frame for completion of all work, as outlined in this proposal,
shall be sixty (60) calendar days from the date of notice to proceed.
(5) After Phase I has been completed and accepted by the Agency and if it is
determined that the extension of Newport Avenue is not feasible, the Agency
may delete the engineering services for Phase II from the project scope of
work.

Mr. Reinhart is experienced in a variety of civil engi~
neering functions. He has directed several major develop-
ment projects and multi-discipline public works projects
involving streets, street lighting, par~ing lots, storm
drainage facilities, concrete and steel structures, water
supply and sewer systems. Studies and projects completed
under his direction also include computerized water, sewer
and storm drain master plans, reservoirs, pipelines, pump
stations and well design, instrumentation, telemetry and
control systems.
Mr. Reinhart is well versed in working with municipal
government agencies on a variety of projects. He is skilled
in the public involvement and the environmental processes,
and has made numerous presentations before City and County
review committees.
Recently, Mr. Reinhart was project manager for a project in
the City of Chino consisting of major roadway design, traf-
fic control, street lighting, traffic signal design, and
major storm drainage improvements.
He is also principal-in-charge of the Thousand Oaks Finan-
cial Plaza, a $30,000,000 development now under constr~c-
tion. This project involved major off-site roadway imprc'~e-
ments as well as on-site street and parking design.
Other projects completed under bis direction include street
wideoing and improvement projects for the Cities of Bell
and Pasadena; storm drain projects for the Cities of South
Pasadena, E1 Segundo and Pasadena; parking facility projects
for E1 Segundo and Pasadena, and numerous sewerage and

Mr. Bennett has extensive experience in the planning and
design of highway and bikeway projects. His experience
includes'all aspects of highway design including highway

of drainage facilities. Experience includes the calculation
of hydrologic and sediment characteristics of a watershed,

Mr. Kreuzer's experience has included the design of urban
arterial roadways, grading, water transmission lines, sewer

niques for the hydrological and hydraulic characteristics of
pipeline systems.
Mr. Kreuzer is the principal designer for the city of
Irvine's Main Street Widening and F-14 Channel project.
This project includes the preparation of .plans, specifica-
tions and cost estimate for 2 miles of arterial roadway and
bikeway.
Mr. Kreuzer is experienced in construction observation and
construction techniques. Prior to joining ASL Consulting
Engineers, Mr. Kreuzer worked as a construction observor for
the County of Orange Environmental Management Agency .and
subsequently worked as a foreman for a major contractor in
the Orange County area.

Mr. Tseng is experienced in all aspects of roadway and high-
way design. Mr. Tseng is knowledgeable in alignment studies,

designed the Park Avenue reconstruction project for the City
of Laguna Beach and portions of Pacific Coast ~ighway for the
City of Newport Beach. Mr. Tseng is familiar with computer-
aided design techniques as they apply to roadway design.
Prior to joining ASL Consulting Engineers, Mr. Tseng spent 12
years as a Project Engineer for a private consulting firm
designing the main freeway in Taiwan. This project was
designed using State of California Department of Transporta-

ASL prepared the traffic study and concept development
for the street and landscaping improvements for Indian
~ill Boulevard from Foothill Boulevard to~ Harrison
Avenue. This phase of the project involved close coor-
dination with the City staff, City Planning Commission
and a Citizen's Advisory Committee. Once the concept
phase was complete, ASL was charged with developing
construction drawings for the street improvements, traf-
fic signal improvements, drainage, landscape and irriga-
tion improvements. Construction: $320,000.

ASL is currently completing the design of the widening
of Main Street from San Diego Creek to Culver Drive.
This project includes highway design, the design of
2,600 lineal feet of RCB storm drain, lighting, right of
way and coordination with the City of Irvine, County of
Orange and The Irvine Company. Construction: $1,000,000
(Bids October, 1985).
ASL prepared alignment studies for 2 miles of new
arterial highway on Bonita Canyon Road. The design
included sound attenuation features, construction of
retention basin and reinforced concrete box culverts and
storm drain system.

Pacific Coast Highway/Jamboree Road intersection
widening and resignalization in the City of Newport

of Palos Verdes Drive North from Hawthorne Boulevard to
the Easterly City limits. Project included roadway,
bikeway and horsetrail design, traffic signals and storm
drain design. The project was divided into two (2) pha-
ses. Phase I (Sunnyfield Road to the City limits) was
constructed in 1982. Phase II (Hawthorne Boulevard to
Sunnyfield Road) was designed in 1983-84 and has not
been constructed. Construction: $1,450,000; Change
Orders: $35,000.
