COLUMBUS-TUSTIN WELL SITE - ELECTRICAL UTILITY EASEMENT - FILE #2930B
RECOMMENDATION:
That the Tustin City Council, at their meeting of December 17, 1984, authorize the
Mayor to execute a Grant of Easement to the Southern California Edison Company for
the installation and maintenance of an electrical utility service to the
Columbus-Tustin wellsite.
BACKGROUND:
The city is in the process of drilling/installing a domestic water well at the
southeasterly corner of Prospect Avenue and Beneta Way which will require an
electrical utility service from the street right-of-way to the point of service at
the wellsite.
Southern California Edison Company has requested the city to grant an easement
across Columbus-Tustin parksite property so that the required electrical service
can be provided to the wellsite.
DISCUSSION:
The attached Grant of Easement provides for a six foot wide easement approximately
35 feet' in length between the easterly right-of-way line on Prospect Avenue to the
point of service at the wellsite to install and maintain the electrical service
run.
This is a typical type easement of which the city has previously granted several
over the past years.

CITY OF TUSTIN, a corporation (hereinafter referred to as "Grantor"), hereby grants to SOUTHERN
CALIFORNIA EDISON COHPANY, a corporation, its successors and assigns (hereinafter referred to as
"Grantee"), an easement and right of way to construct, use, n~intain, operate, alter, add to, repair,
replace, reconstruct, inspect and remeve at any tine and from time to tine underground electrical supply
syste~ and cmmunication syste~ (hereinafter referred to as "syste~"), consisting of wires, underground
conduits, cables, vaults, n~nholes, handholes, and including above-ground enclosures, ~rkers and concrete
ads and other a urtenant fixtures and equipnent necessary or useful for distributing electrical energy
~nd for transmit~Jg intelligence by electrical neans, in, on, over, under, across and along that certain
real property in the County of Orange, State of California, described as follows:
That portion of the land in the City of Tustin, County of Orange, State of California, allotted
to Leonor Yorba de Rowland by the Final Decree of Partition of the Rancho Santiago de Santa Aha, which
was entered September 12, 1868 in Book "B", page 410 of 3udgaents of the District Court of the l?th
Judicial District in and for Los Angeles County, California, described in deed to the Orange County
Flood Control District, recorded Septent~er 19, lg6Z in Book 6253, page 951 of Official Records in the
office of the county Recorder of said Orange County.
EXCEPT that portion thereof lying northerly of the southerly line and its westerly prolongation of the
land described as "PARCEL NO. l" ~n deed to County of Orange, recorded August 12, 1970, in book 9373,
782 of said Official Records.
ALSO EXCEPT that portion thereof included within the land described as "PARCEL NO. 1.1" in said last
nentioned deed.
A strip of land 6 feet in width lying within the hereinabove described property; the centerline of
said strip being described as follows:
BEGINNING at a point 40 feet easterly and 95 feet southerly, measured at right angles f~om the
centerlines of Prospect Avenue and Deneta Way, respectively, as now established; thence northermy to a
point 75 feet easterly and 78 feet southerly, neasured at right angles from said centerlines of Prospect
Avenue and Beneta Way, respectively.
The Grantor agrees for itself, its successors and assigns not to erect, place or n~intain, nor to
permit the erection, placement or n~intenance of any building, planter boxes, earth fill or .ot~er
structures except walls and fences on the above described real property. The Grantee, ano its
contractors, agents and enployeos, shall have the right to trim or cut tree roots as n~y endanger or
interfere with said syste~ and shall have free access to said syste~ and every part thereof, at all
tines, for the ~urpose of exercising the rights herein granted; provided, however, that in ~klng any
excavation on sa~d property of the Grantor(s), the Grantee shall n~ke the sane in such a n~nner as will
cause the least injury to the surface of the ground around such excavation, and shall replace the earth so
re~ved by it and restore the surface of the ground to as near the s~ne condition as it was prior to such
excavation as is practicable.
