HomeMy WebLinkAboutCC 7 USE PERMIT 84-23 12-03-84 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 CONSENT CALENDAR NO. 7 12-3-84 RESOLUTION NO. 84-99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, OVERRULING THE PLANNING COMMISSION APPROVAL OF USE PERMIT 84-23 THEREBY DENYING AUTHORIZATION TO CONSTRUCT A 2,418 SQUARE FOOT SAVINGS AND LOAN BUILDING AT 500 EAST 1st STREET (LARWIN SQUARE) The City Council of the City of Tusttn does hereby follows: De resolve as That a proper application, (Use Permit No. 84-23) was filed on behalf of Larwtn Square Ltd. requesting authorization to construct a 2418 square foot savings and loan building at 500 E. 1st Street in the shopping center known as Larwtn Square. That a public hearing before the Planning Commission was duly called, noticed and held on said application. That the Planning Commission did approve Use Permit 84-23 by the adoption of Resolution No. 2192. That on November 5, 1984 the City Council did, by a vote of five ayes to zero noes, appeal the Planning Commission's approval of Use Permit 84-23. That a public hearing before the City Council was duly called, noticed and held on said appeal on November 19, 1984. II. The City Council finds and determines as follows: Ae That establishment, maintenance, and operation of the use applied for in the proposed location would, under the circumstances of this case, be detrimental to the safety, comfort and general welfare of persons working and shopping in the center evidenced by the following: The development of the proposed project would adversely impact existing traffic circulation patterns in the center and would constitute a vehicular and pedestrian safety hazard within close proximity of the proposed use location. That the configuration of the parking lot allocates spaces in such a manner that an additional structure at the proposed location would create increased parking problems and congestion in a portion of the center subject to significant vehicular movement. That establishment, maintenance, and operation of the use applied for would be detrimental to existing uses within the center due to reduced visibility resulting from additional building construction adjoining the Newport at Bryan Avenue entryway. 1 2 3 4 5 6 7 8: 10 11 19. 13 14 16 17 18 10 ~0 ~8 Resolution No. 84-99 page two III. The City Council hereby denies Conditional Use Permit 84-23 as submttted. PASSED AND ADOPTED at a regular meeting of the Tusttn City Council held on the day of , 1984. Attest: URSULA E.
