Properties 1-3 appear to be designated High Density Residential;
Properties 4 and 8 are Community Commercial; Properties 5-8

The scope of this activity is within the scope of the mitigated
Negative Declaration adopted by the City Council for the Tustin
Library Expansion Project adopted on May 6, 2002.

RECOMMENDATION
That the Planning Commission adopt Resolution No. 3891 determining that the location,
purpose, and extent of acquisition of the site and vacation of a portion of Preble Drive
between Main Street and Third Street for the Tustin Library Expansion Project is in
conformance with the Tustin General Plan.
BACKGROUND/DISCUSSION
Section 65402(c) of the California Government Code (Planning and Development Law)
requires a general plan conformity determination from local planning agencies prior to
acquisition or disposition of real property by a local agency such as a redevelopment
agency within the planning agency's jurisdiction or for a proposed street vacation or
abandonment.
The Tustin City Council has identified design and construction of the Tustin Library
Expansion Project as a top priority and instructed staff to pursue property negotiation,
acquisition, and street vacation for an expanded library site (Attachment A - Library Site
Exhibit). The City will be applying for funding for design and construction of the project
from State grant funds pursuant to the California Reading and Literacy Improvement and
Renovation Act of 2000. The Planning Commission is authorized to determine whether
the location, purpose, and extent of the proposed acquisition and street vacation are
consistent with the General Plan.
The Tustin Library Expansion Project is a public institutional use. Public institutional uses
which are compatible with and oriented to serving the needs of neighborhoods would be
permitted within the High Density and Community Commercial General Plan Land Use
designation. The location, purpose, and extent of the proposed acquisitions for the Tustin
Library Expansion Project and the proposed vacation of a portion of Preble Drive between
Main Street and Third Street are in conformance with the General Plan.

RESOLUTION NO. 3891
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN DETERMINING THAT LOCATION, PURPOSE,
AND EXTENT OF THE PROPOSED ACQUISITION OF
PROPERTIES AND STREET VACATION OF PREBLE DRIVE
FOR THE TUSTIN LIBRARY EXPANSION PROJECT
CONFORMS WITH THE TUSTIN GENERAL PLAN.
The Planning Commission does hereby resolve as follows:
I. The Planning Commission finds and determines as follows:
That the City of Tustin and Tustin Community Redevelopment Agency
propose the acquisition of properties within the City of Tustin for the Tustin
Library Expansion Project. Said properties include properties located at
280-284 East Third Street (APN 401-593-01), 320-324 South Preble Drive
(APN 401-593-02), 330-332 South Preble Drive (APN 401-593-03), 285
East Main Street (APN 401-593-04), 300-304 East Third Street (APN 401-
592-10), 325-329 South Preble Drive (APN 401-592-11), 335-339 south
Preble Drive (APN 401-592-12), and 305 East Main Street (APN 401-592-
13,14, and 15). A portion of Preble Drive between Third Street and Main
Street in use for street and highway purposes is also proposed for a street
vacation for the Tustin Library Expansion Project.
That California Government Code Section 65402 (c) provides that no real
property shall be acquired or real property disposed, nor street vacated or
abandoned, and no public building or structure constructed or authorized
until the location, purpose, and extent of the project has been reported upon
by the local planning agency as to the conformity with the applicable,
adopted general plan.
That the City Council has identified the Tustin Library Expansion Project as a
top priority and has instructed staff to pursue property negotiation and
acquisition for the expanded library site. The City will be applying for funding
for design and construction of the project from State grant funds pursuant to
the California Reading and Literacy Improvement and Renovation Act of
2000.
That general plan conformity determinations required by Government Code
Section 65402(C) are not "projects" requiring environmental review pursuant
to the California Environmental Quality Act.
II.
The Planning Commission hereby determines that the location, purpose, and extent
of the acquisition of properties and street vacation of Preble Drive for the Tustin
Library Expansion Project are in conformity with the Tustin General Plan.
