Chairman White opened the public hearing at 8:00 p.m. The following person-spoke in
favor of Zone Change 84-6: Mark Ferguson, applicant, questioned the ~ecessity for
two exits and requested the City donate water and sewage fees since it is a public
serv$ce project.
Seeing no one further wishing to speak, Chairman White closed the hearing at 8:14
p.m. Commission discussion ensued concerning the Uniform Building Code requirements
for two exits and they advised Mr. Ferguson to present his request to the City
Council for waiver of fees for water and sewage. Further discussion ensued
concerning staff's recommendation for a roof parapet, outside parking area and age'
restrictions for tenants.
Commissioner Well moved, Sharp second to recommend approval to the City Council by
the adoption of Resolution 2188 with the conditions contained in Exhibit "A". Motion
carried 5-0.
7. REVOCATION HEARING FOR USE PERMIT 80-2~
Applicant: City of Tustin
Location: 1651 Mitchell Avenue/Windsor Gardens Apartments
Request: Consideration of revoking use permit thereby terminating the
conversion from apartments to condominiums.
Presentation: Donald D. Lamm, Director of Community Development
Chairman White opened the public hearing at 8:25 p.m. The following people spoke in
favor of revoking Use Permit 80-21: Mark Rafter, tenant, explained in detail the
the existing living conditions at the complex. Michael Daly, property owner on two
sides of complex, felt this project was a disgrace to the community due to the
numerous police reports, fire hazards, health hazards, trees and fences collapsing
onto his properties.
Seeing no one further wishing to speak, Chairman White closed the hearing at 8:50
p.m. Commission discussion ensued over the developer's desire to complete the
project and what incentive the City could provide.
Commissioner Sharp moved, McCarthy second to recommend to the City Council revocation
of Use Permit 80-21. Motion carried 5-0.

C6mmissioner Sharp expressed concern and wondered if the City can prohibit any
further Windsor Garden type projects.
Commissioner Well thanked Jeff Davis for the letter to Redhill Shopping Center.
Commissioner White requested a letter to Alan Warren. He further commented that he
didn't feel zone changes should be contingent upon development plans, but development
plans should require, conditional use permits .

CAPITAL IMPROVEMENT PROGRAM
BACKGROUND:
Section 65401 of the California Government Code states that each community with
an adopted General Plan shall prepare a list of proposed public works projects
for each year, and this list shall be reviewed and adopted as a public works
program by the City Council for that community.
Additionally, this approved list of proposed public works projects.shall be
submitted to the Planning Commission. Their task is to review the subject list
and determine if this program is in conformance with. the City's General Plan,
and report their finding to the City Council.
DISCUSSION:
The City of Tustin maintains a five year capital improvement program. Each year
at budget time, the program is updated for the next fiscal year and submitted t~
the City Council for their review and input. As a part of the budget process,
the City Council adopts the five year capital improvement program.
The adopted five year program for fiscal year 1984-8S has been enclosed for your
review. In regard to the City's General Plan, the capital improvement program
is consistent with the intent of the Master Plan of Arterial Highways,
consistent with the goal of Protecting the public health, safety and general
welfare, and with the specific objective of upgrading public improvements to
ensure a quality living environment for the citizens of Tustin.
Developing a five year program ensures that adequate advanced and financial
planning can ~ke place, and goes beyond the intent of Section 64S01 requirement
of examining capital improvements at only one year at a time.
RECOf,~IENDATION:
Staff recommends that the Planning Commission, by minute order, report to the
City Council that the adopted 1984-85 five year capital improvement program is
in conformance with the Tustin Area General Plan.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA APPROVING USE PERMIT
NO. 84-23 AUTHORIZING THE CONSTRUCTION OF A 2418
SQUARE FOOT COMMERCIAL BUILDING, AND THE CONVERSION
OF AN EXISTING KEY SHOP TO AN AUTOMATED BANK TELLER
IN THE SHOPPING CENTER KNOWN AS LARWIN SQUARE.
The Planning Commission of the City of Tustin does hereby resolve as
follows:
I. The Planning Commission finds and determines as follows:
A. That a proper application, (Use Permit No. 84-23) has been filed
-by Morrey-Friedman on behalf of Larwin Square Ltd., requesting
authorization to construct a 2418 square foot commercial
building and convert an existing key shop to an automated teller
machine in the shopping center known as Larwin Square. The
precise location of the 2418 square foot structure is noted on
Exhibit "B" attached and incorporated herein by reference.
B. That a public hearing was duly called, noticed and held on said
application.
C. That establishment, maintenance, and operation of the use
applied for will not, under the circumstances of this case,
be detrimental to the health, safety, morals, comfort, or
general welfare of the persons residing or working in the
neighborhood of such proposed use, evidenced by the following
findings:
1. The use is in conformance with the Tustin Area General Plan
and with the Tustin Zoning Code as they pertain to
commercial development.
2. That the traffic circulation patterns at the entrance to
the center located at the intersection of Newport and Bryan
Avenue will be modified to alleviate traffic conjestion and
increase pedestrian and vehicular safety.
D. That the establishment, maintenance, and operation of the use
applied for will not be injurious or detrimental to the property
and improvements in the neighborhood of the subject property,
nor to the general welfare of the City of Tustin, and should be
granted.
E. The proposed development shall be in accordance with the
development policies adopted by the City Council, Uniform
Building Codes as administered by the Building Official, Fire
Code as administered by the Orange County Fire Marshal and
street improvement requirements as administered by the City
Engineer.

A Negative Declaration of environmental impact is hereby
approved in accordance with the California Environmental Quality
Act.
G. Final development plans shall require the review and approval of
the Community Development Department.
II.
The Planning Commission hereby approves Conditional Use Permit No.
84-23 authorizing the construction of a 2418 square foot commercial
building and the conversion of an existing key shop to an automated
bank teller as- applied for subject to the conditions contained in
.Exhibit "A" attached and incorporated herein by reference.

That "Alternative 1" outlined in the Traffic Study conducted by
Basmaciyan-Darnell, Inc. be incorporated into the existing circulation
system in Larwin Square.
That "stop" signs be placed at locations where minor drive aisles empty
into the main drive aisle that traverses diagonally across the center.
That the main drive aisle be delineated so that this ~o-way traffic is
clearly indicated.
That five (5) parking stalls immediately adjacent to the proposed
automated teller be marked for "Automated Teller Parking Only".
The final site plan shall be standardized and reflect all appropriate city
standard drawing numbers. The develoPer shall construct all missing or
damaged street improvements to said development per the City of Tusttn
"minimum Design Standards of Public Works" and "Street Improvement
Standrds". This work shall consist of, but is not limited to: curbs and
gutters, sidewalks, drive apron, street pavement, street trees and
marbelite street, lights with underground conduit.
A grading plan will be required for review and approval prior to issuance
of a grading permit.
Orange County Sanitation District No. ? connection fees in the amount of
$50.00 per 1,O00 square feet of floor area will be required at the time a
building permit is issued.
Payment of East Orange County Water District fees will be required at the
time a building permit is issued.
Continuous 6" concrete curbs shall be provided along landscape planters
adjacent to parking spaces and drive aisles.
The developer shall comply with all construction requirements of the
Orange County Fire Marshal's office which includes installation of
necessry fire extinguishers, on-site private fire hydrants and fire
sprinkler system.
A comprehensive signing plan shall be approved by' the Community
Development Department prior to installation of any building or
free-standing monument signing.
A landscape plan shall be submitted to the Community Development
Department for review and approval prior to installation or modification
of any landscape planter. Said plan shall include:
a. location, size and species of all specimen trees, shrubs and
vegetative ground cover;

b. soil amendment specifications to insure proper plant growth.
13. Wheelchair and handicap access shall be installed on-site and off-site in
accordance with the State of Californi~ and City of Tustin Building
Department standards.
On-site security lighting shall be arranged so that direct rays will not
shine on adjacent properties or produce glare for street traffic. All
roof-mounted equipment, such as heating and air conditioning units, shall
~be completed screened from public view by architecturally compatible
screening material, subject to the approval of City staff.
lB. The Automated T~ller shall not have recessed doorways or chambers; shall
be unobstructed by trees or shrubbery; and must be equipped with protected
lighting.
16. That any future additions to the center shall require approval, of a
Conditional Use Permit, and a reassessment of the approval-granted by Use
Permit 76-25 will be conducted.
17. The building materials and colors for the proposed 2400 square foot
building and the automated teller shall be reviewed and approved by the
Community Development Department.

The Planning .Commission of the City of Tustin does hereby resolve as
follows:
I. The Planning Commission finds and determines as follows:
That a proper application, (Use Permit No. 84-24) has been filed
by Albert Auer to authorize the development of 104,300 square
feet of R&D, 39,000 square feet of professional office and
10,000 square feet of retail commercial.
B. That a public hearing was duly called, noticed and held on said
application.
C. That establishment, maintenance, and operation of the use'
applied for will not, under the. circumstances of this case,
be detrimental to the health, safety, morals, comfort, or
.general welfare of the persons residing or working in the
neighborhood of such proposed use, evidenced by the following
finding:
1. This proposed project will generate approximately 2,000
vehicle trips per day as opposed to the previously proposed
project which would have generated 11,340 trips per day.
D. That the establishment, maintenance, and operation of the use

nor to the general welfare of the City of Tustin, and should be
granted.
E. Proposed development shall be in accordance with the development

PROPOSED CONDITIONS OF APPROVAL
USE PER~IT 84-24
1. A final grading plan based upon U.S.G.S. datum will be required. This
plan should delineate how all on-site storm water drainage will be
disposed of.
2. All work within the public right-of-way should be shown on the final site
and/or grading plan and should be so referenced with appropriate city
standard drawing references. These improvements will include but not be

b. domestic/fire water services
c. sidewalks
3..' The most westerly driveway on Walnut Avenue (at the median opening) is
shown at 30 feet of width. The 'existing radius type driveway opening
is currently constructed at a width of 40 feet. The final plan should be
revised to refect this width.
4. The most easterly driveway, as shown, will be limited to right turn
ingress to and right turn egress from the site only. This driveway should
also be constructed as a radius type driveway.
5. Vehicular access rights to Walnut avenue at this location will require
relinquishment by the City Council. Prior to finalization of these plans,
the developer should request this relinquishment by letter to the City
Council.
6. Franklin Avenue i-s shown as an 80 foot wide right-of-way. It is a
variable width right-of-way from 80 ft. to 60 ft. and should be shown as
such on the final plans.
7. A parcel map shall be recorded to subdivide this parcel.
B. The most northerly driveway on Franklin may be located in a conflicting
area with respect to the pavement striping on Franklin Avenue. This
striping should be plotted on the final plan to determine if the driveway
requires relocation.
g. A sewer plan Should be prepared indicating the on-site layout of alt sewer
facilities with respect to the proposed water facilities.
10. Payment of Orange County Sanitation District No. 7 sewer connection fees
in the amount of $50.00 per 1,000 sq. ft. of building area will be
required at the time a building permit is issued.

Exterior building materials and colors must be submitted to Community

lot and landscape areas shall be approved by the Community Development

traffic shall be resolved which may include:
(a)' Restriptng of Walnut Avenue and Franklin Avenue.
(b) Participation (fair share) in the future signalization of

The Planning Commission of the City of Tustin does hereby resolve as

I. The Planning Commission finds and determines as follows:
A. That a proper application was filed by Mark Ainslie
on behalf of Ainslie Development pursuant to the

BACKGROUND: ~
The subject.site is the western portion of the First Christian Church property
located at 1372 Irvine Blvd. The site is currently a vacant lot, with adjacent
single family residents on the west and south sides, and the church complex
located to the east of the site.
The Planning Commission and City Council have recently considered a request to
amend the land use element of the Tustin General Plan for this site. On
September 24, 1984 the Planning Commission recommended that the City adopt the
change from Public & Institutional to Professional, and the City Council adopted
this change at its regular meeting on October 15, 1984.
DISCUSSION:
The applicant is proposing a change to the Professional District (PR) which
permits a variety of professional office uses. All of these potential office
uses are permitted by right within a set of development standards, which are
enclosed for your review.
The current desfgnation of Public & Institutional also permits a variety of
institutional uses (schools, churches, hospitals, etc.), but any proposal
requires the approval of a use permit. In order for the proposed zone district
to maintain the same level of review as the property must currently comply wi th,
a use permit must be required for any proposed project.
The State of California will allow a zone change to be subject to conditions if
the appHcant consents to the imposed conditions. Mr. O'Connor has submitted a
letter to the Community Development Department indicating his willingness to

accept this condition. Further, he has submitted all the necessary exhibits and
-applications for a Use Permit, and staff has accepted this filing and advertised
for a public hearing for a Use Permit. Mr. O'Connor's consent binds all future

BACKGROUND:
The subject site is the northwest portion of the First Christian Church property
located at 1372 ]rvine. The site Is currently a vacant lot, adjacent to sln91e
family residential to the west and south, and the church complex to the east.
The Planning Commission and City Council recently amended the Land Use of the
subject site from a Public & Institutional designation {P&I) to a Professional
designation (PR).
The applicant is now seeking to change the zone to a Professional District {PR)
and receive approval of a Use Permit to construct a professional office
building.
DISCUSSION:
As stated in several previous staff reports, the applicant is seeking approval
to construct a 13,000 square foot professional office building fronting on
Irvine Blvd. and just west of Redhill Avenue. The approximate size of the
subject property is 30,000 square feet.
The development will need to supply 44 parking spaces at one per 300 square feet
to support a 13,000 square foot building. This development is supplying 47
parking spaces, of which 14 spaces will be located on the church property and
shall be part of a reciprocal parking agreement.
The number of parking spaces for the project will support all professional and
general offices identified in the Professional District, with the exception of
any medi.cal office uses. The applicant will need to supply parking at six (6)
per thousand square feet to permit these uses.

The applicant has attempted to minimize the impact of this office on adjacent
residential areas by fronting the building on Irvine Blvd. and placing the bulk
of the structure adjacent to the church complex. Still, staff would recommend
that appropriate landscaping be planted adjacent to residential units that help
buffer and minimize the impact of the parking lot and structure. Additionally,
all second story windows that are immediately adjacent to residential areas
should be t6anslucent to a height of four feet from the bottom of the window
sill or six feet from the finished floor elevation of the second story.
The building will be a two story structure with an overall height of 34' 6".
The architectural motif is reminiscent of the spanish style with the use of
spanish tiles for the roof, and a tan exterior with dark brown trim. Vehicles
enter through a portecochere with a high point of 12' 6". The applicant has
provided a secondary vehicular access that can be utilized by vehicles visiting
the offices, as well as emergency vehicles that cannot use the portecochere
entrance. A reciprocal agreement will be required for a trash service truck to
access and serve the site.
CONCLUSIONS:
1. The subject project supplies sufficient parking for all office uses with
the exception of medical offices.
2. The applicant has attempted to design the project with consideration to
the adjacent residential uses.
3. The applicant will need reciprocal agreements for access and parking on
adjacent church property.
4. An environmental review of the proposed project shows that the proposed
project will not a significant effect on the environment, and a Negative
Declaration is recommended.
5. The project meets or exceeds all development standards of the Professional
District, with the exception of parking for medical dental offices.
6. The proposed architecture should be an enhancement for the surrounding
area.
RECO~£NDATION:
Staff recommends that the Planning Commission adopt Use Permit 84-26, by the
approval of Resolution No. 2196.

The Planning Commission hereby apprdves Conditional Use Permit 84-26,
to authorize the development of a 13,000 square foot professional
office building at the northwest portion of 1372 Irvine Boulevard,
subject to the following conditions:
A. The final site plan shall be standardized and reflect all
appropriate City standard drawing numbers. The developer shall
construct all missing or damaged street improvements to said
development'per the City of Tustin "Minimum Desigh Standards of
Public Works" and "Street Improvement Standards". This work
shall consist of,but is not limited to: curbs and gutters,
sidewalks, drive aprons, street trees, and street pavement.
B. A final grading plan shall be required for review and approval.
C. A landscape plan shall be required for review and approval prior
to the issuance of building permits.
D. This use permit shall become effective when Zone Change 84-7 has
been adopted by the City Cguncil.
E. This use permit shall not be applicable for medical-dental
office uses, unless said use permit is amended and adequate
parking is provided.
F. Prior to building permit issuance, reciprocal access agreements
shall be required for parking spaces off-site and ingress and
egress into the subject property.
G. Prior to building permit issuance, a vehicular reciprocal access
agreement shall be required for trash service to the subject
property.
H. Fenestration on the second floor and immediately adjacent to
residential areas shall be translucent to a height of six feet
from the finished floor of the second story or four feet from
the bottom of a window sill.
I. At the time building permits are issued, County Sanitation
District connection fees and East Orange County water District
fees shall be required.
J. The proposed office shall have its own domestic water service
and sanitary sewer lateral.
K. Any subsequent construction documents shall be in substantial
conformance with the site plan and elevations that are submittd
and approved by the Planning Commission at a public hearing.
L. The Master Site Plan shall be prepared in conformance with the
City's sign ordinance.

The subject map of 2.174 acres has been submitted to create two parcels, from one
existing parcel. The First Christian Church occupies both parcels and after the
subdivision will occupy parcel 2 only. Parcel 1 is for the proposed office
building for Corniche Development Corporation. If the zone change {Zone Change
84-7) and use permit {Use Permit 84-26) are approved, it would then be
appropriate to take action on this map.
On October 15, 1984, the City Council approved General Plan Amendment No. 84-4A
which changed the land use on Parcel 1 from Public and Institutional to
Professional Office. The map is in conformance with the Tustin Area General
Plan.

a Temporary Use Permit must be obtained.
Please be advised that unless a Temporar~ Use Permit is obtained

a Temporary Use Permit is $25.00 with an additional refundable
