11th YEAR APPLICATION IN THE COI~4UNITY DEVELOPMENT
BLOCK GRANT PROGRAM (HCD)
BACKGROUND:
The City initially took part in this program in 1974, 1975 and 1976 and
successfully completed projects which included storm drain installation 'on E1
Camino Real, sidewalks, curbs and gutters in various parts of the old town area
and a planning study for the E1Camino Real area. In 1981, the City submitted
an application to the County for 8th year- funding (82-83) and received the
following:
1. $50,000.00 for residential rehabilitation loans;
2. $50,000.00 for the installation of a storm drain on-Mitchell Street in the
South "B" Street/Mitchell target area.
The storm drain on Mitchell was installed in Spring 1984 and the rehabilitation
money has been awarded for various projects.
The City was awarded the following amounts for the 9th year program (83-84):
1. $75,000.00 for rehabilitation loans;
2. $75,000.00 for street improvements (curbs, gutters, street lights,
sidewalks) in the South "B" Street/Mitchell target area.
Also, in June 1983, the City was awarded $65,000.00 from the Special Emergency
Jobs Bills Grant (Public Law 98-8) for the continuation of street reconstruction
in the "B" Street/Mitchell target area.
Last year the City was awarded the following amounts for the loth year program
which will be available in a few weeks:
1. $25,000.00 for rehabilitation loans;
2. $100,000.00 for street improvements, curbs and gutters, street lights.
To date all of the rehabilitation money {for years 8,9,10) has been awarded to
owner occupied residences and rental rehabs. The County has advised that if any
further contracts are awarded for City of Tustin rehabs before October 1985, the
money will be supplied by the County of Orange Home Improvement fund.
In December of 1984 the City will begin the improvement of South "B" Street and
installation of an additional storm drain. By June of 1985 the City proposes to
complete all of the remainder of the street improvements for the South "B"
Street area with year 9 and 10 monies.

DISCUSSION:
The City is required to have a citizen advisory committee {Community Development
Advisory Board, CDAG) to advise the County of projects and this submittal. The
members of the CDAB for the 11th year funding include:

The CDAB met with City staff on October~ 29, lg84 and made the following
recommendations:
Request the following funds for the HCD program for the 11th year (lg85-86):
Public Facilities Improvements - $150,000.00
(This would al.low the City to start street improvements in the
Orange/Bonita/Walnut Street target area)

Rehabilitation of Housing Stock - $200,000.00
{Low interest loan program. Since our rehabilitation monies are all
committed through October 1985, we need to replenish the fund for further
rehabs.)
Smoke Detector Purchase - $5,000.00
(If the TAC I Committee can prepare a method of administration for
distribution of the detectors, the County will consider the program.)
The Board also discussed the future Tusttn Senior Center and methods of
financing. When a site is selected and plans are started, application can then
be made to HCD for partial funding.
RECOMMENDATION:
Approve by Minute Order, submittal of the 11th year CDBG application for fiscal
year 1985-86 as recommended by the Community Development Advisory Board and
staff.

BACKGROUND AND DISCUSSION:
Following a series of informal workshops and public hearing~, and based on the
information and public input received therefrom, the City Council has directed
that the Tustin Zoning Ordinance be amended to require a Conditional Use Permit
for any business which sells alcoholic beverages.
Attached is a draft Ordinance prepared by the City Attorney that would amend the
City Code as directed by the Council. The Planning Commission reviewed the
draft ordinance, and by the adoption of Resolution 2187 recommended that the
Council approve Ordinance 920 as written. _
RECOI~tENDED ACTION:

ORDINANCE NO. 920
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, APPROVING ZONING ORDINANCE AMENDMENT NO.
84-3 THEREBY AMENDING SECTIONS 9232b(p), 9233c(v),
9234c(10), 9235c(dd), 9242b(g) AND 9297 OF THE TUSTIN
MUNICIPAL CODE, TO REQUIRE THE ISSUANCE OF A CONDITIONAL
USE PERMIT FOR ANY BUSINESS WHICH SELLS ALCOHOLIC BEVERAGES
WHEREAS, on September 17, 1984, the City Council
directed the City Attorney to prepare an ordinance requiring
the granting of a conditional use permit before alcoholic
beverages can be sold by any business located within the City
of Tustin.
NOW, THEREFORE, the City Council of the City of Tustin,
California, does ordain as follows:
Section 1: Section 9232b(p) of the Tustin Municipal
Code, is amended as follows:
"A. 'Liquor Stores (including 'On-Sales') is
deleted as a conditionally permitted use.
B. 'Alcoholic. Beverage Sales Establishments' shall
be added to uses allowed subject to a conditional
use permit."
Section. ~: Section 9233c(v) of the Tustin Municipal
Code is amended as follows:
"A. 'Liquor Stores (including 'On-Sales')' is
deleted as a conditionally permitted use.
B. 'Alcoholic Beverage Sales Establishments' shall
be added to uses allowed subject to a conditional
use permit".
Section ~: Section 9234c(10) of the Tustin Municipal
Code is amended as follows:
"'Alcoholic Beverage Sales Establishments' shall be
added to uses allowed subject to a conditional use
permit".
Section 4: Section 9235c(dd) of the Tustin Municipal
Code is amended as follows:
"A. 'Liquor Stores (Including 'On-Sales')' is
deleted as a conditionally permitted use.
B. 'Alcoholic Beverage Sales Establishments' shall
be added to uses allowed subject to a conditional
use permit."

Section ~: Section 9242b(g) of the Tustin Municipal
Code is amended as follows:
"'Alcoholic Beverage Sales Establishments' shall be
added to uses allowed subject to a conditional use
permit."
Section [: Section 9297 of the Tustin Municipal code
is amended to add the following definition, integrated in
alphabetical order, to read as follows:
"'Alcoholic Beverage Sales Establishment' means any
establishment where an alcoholic beverage is sold,
including, but not limited to, liquor stores, bars,
lounges, restaurants, markets, mini-marts, gas
stations, drive-in dairies, bakeries and florists."
