RECOI~ENDED ACTION:
Adoption of Resolution No. 84-92 initiating proceedings and ordering the
annexation of certain uninhabited territory designated as Gylah-Warren
Annexation No. 134 to the City of Tustin.
BACKGROUND:
Bill and' Robin Burk, 14582 Gylah Lane, desire to purchase a portion of the
adjoining undeveloped lot in the city of .Tustin. To permit a lot line
readjustment, the properties must be within the same political jurisdiction.
The Burks filed an application for the annexation of their residence to the city
of Tustin and the Local Agency Formation Commission approved the annexation. By
terms of LAFCO Resolution No. 84-46, the Burks will be responsible for paying
the Board of Equalization processing fees in the amount of $160.00.
The annexation may be approved without the necessity of notice and hearing.

RESOLUTION NO. 84-92
A RESOLUTION OF THE CITY COUNCIL OF THE CITY '
OF TUSTIN, CALIFORNIA, INITIATING PROCEEDINGS
AND ORDERING THE ANNEXATION OF CERTAIN UNINHABITED'
TERRITORY DESIGNATED AS GYLAH-WARREN ANNEXATION
NO. 134 TO THE CITY OF TUSTIN
WHEREAS, an application 'was made to the Local Agency Formation
Commission by Bill and Robin Burk for the annexation of a 0.23 acre parcel
located on the easterly side of the southerly terminus of Gylah Lane for
the purpose of gaining full municipal services and to permit a lot line
adjustment within the jurisdiction of t~e city; and
WHEREAS, the City Council by Resolution No. 84-46 agreed to the
exchange of property taxes with the County of Orange for said annexation
and consented to the processing of said annexation by the Local Agency
Formation Commission; and
WHEREAS, the Local Agency formation Commission conducted a public
hearing on October 3, 1984 and by Resolution No. 84-69 authorized the city
of Tustin to be the conducting'authority to initiate annexation proceedings
for the proposed uninhabited area subject to specified terms and
conditions.
NOW THEREFORE, BE IT RESOLVED by the City Council, City of Tustin,
California:
The boundaries of the territory proposed to be annexed to the
City of Tustin are specifically described by the map and legal
description attached hereto and by this reference made a part
hereof (Exhibit ,A" and "B"). Said territory is found to be
uninhabited and is assigned the following short-term
designation: Gylah-Warren Annexation No. 134 to the City of
Tustin.

Annexation proceedings are authorized without notice and hearing
and without an election.
The applicants, Mr. and Mrs. Bill Burk, shall be liable for and
pay the applicable State Board of Equalization filing and
processing fee prior to the issuance of the final statement of
boundary change by the Executive Officer of the Local Agency
Formation Commission.
D. The City Council hereby orders the annexation of Gylah-Warren
No. 134 to the City of Tustin.
Subject annexation shall be effective upon the filing and
recording of the certificate of completion by the Executive
Officer of the Local Agency Formation Commission.

F. The City Clerk shall transmit a certified copy of this
Resolution to the Executive Officer of the Local Agency
Formation Commission.
PASSED AND ADOPTED at a regular meeting of the City Council, City. of
Tustin, held on the ~day of , 1984.

RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION
OF ORANGE COUNTY, CALIFORNIA
October 3, 1984
On motion of Commissioner Jarrell, duly seconded and carried, the following
resolution was adopted:
WHEREAS, a petition for the proposed annexation designated Gylah-Warren
Annexation NO. 134 to the City of Tustin in the County of Orange was heretofore filed
by Bill.and Robin Burk and accepted for filing August 23, 1984 by the Executive Officer
of this Local Agency Formation Commission pursuant to Part 2 of Title 4, Division 2,
co~encing with Section 35000 et seq of the Government Code;
WHEREAS, the Executive Officer, pursuant to Government Code Section 35152
set October 3, 1984, as the hearing date on this proposal and gave the required notice
of hearing; and
WHEREAS, the Executive Officer, pursuant to Government Code Section 54794,
has reviewed this proposal and prepared a report including his recommendation thereon,
and has furnished a copy of this report to each person entitled to a copy; and
WHEREAS, said petition was accompanied by proof satisfactory to this
Commission that all of the owners of land within the territory proposed to be annexed
have given their signed consent to such annexation and determination; and
WHEREAS, this Commission called this proposal for public hearing on
October 3, 1984, considered the proposal and the report of the Executive Officer, and
considered the factors determined by the Commission to be relevant to this proposal,
including, but not limited to, factors specified in Government Code Section 54796; and
WHEREAS, the Executive Officer determined this annexation project to be
categorically exempt from the provisions and requirements of the California
Environmental Quality Act.
NOW, THEREFORE, the Local Agency Formation Commission of the County of
Orange DOES HEREBY RESOLVE,

DETERMINE and ORDER as follows:
Subject to the terms and conditions'hereinafter specified,
said proposal is approved.
The boundaries of the territory proposed to be annexed to
the city of Tustin are specifically described in the legal
description attached hereto and by this reference made a
part hereof. Said territory is found to be uninhabited,
and is assigned the following designation: Gylah-Warren
Annexation No. 134 to the City of Tustin.

The city of Tustin is designated as the conducting
authority and the legislative body thereof is hereby
directed to initiate annexation proceedings in compliance
with this resolution.
Proceedings of the legislative body of the conducting
authority may be held without notice and hearing, without
an election, or both.
Mr. and Mrs. Bill Burk, as applicants, shall be liable and
pay the applicable State Board of Equalization filing and
processing fee prior to the issuance of the final statement
of boundary change by the Executive Officer of the Local
Agency Formation Commission.

Those portions of Lot 26 and Lot 27 of the Supplementary Map of the Vanderl~p
and Rowan Tract in the County of Orange, State of California, as per map
recorded in Book 1, Page 27, of Miscellaneous Record Maps in the office of
the County Recorder of said County described as follows:
Beginning at a point in the existing boundary of the City of Tustin as
established by "W~rren-Newport Annexation No. ll5"; said point being distant
thereon North 0°26'30" West 66.00 feet from the Southerly teminus of that
certain course described as "South 0°26'30" East, 618.52 feet" in said annexa-
tion; said point also being the Northwest corner of that parcel of land granted
to Bill Burk and Robin Burk by a deed recorded October 30, 1979 in Book 13374
Page 1538 of Official Records of said County;
Thence, leaving said existing boundary and along the boundary of said deed
the following courses; North 89046'30'' East 152.61 feet to the East line of
said dee~South 0°26'30'' East 66.00 feet to a course in said existing City
boundary line described in said "Annexation No. ll5" as "North 89°46'30'' East
275.07 feet"i thence along said existing boundary line and continuing along
the boundary line of said deed South 89°46'30'' West 152.61 feet and North
O°26'30"'West 66.00 feet to the Point of Beginning.
