QUITCLAIM DEED - FILE #1960
RECOMMENDATION:
That the Tustin City Council, at their meeting of November 5, 1984, authorize the
Mayor to execute the attached Quitclaim Deeds and direct staff to record said
documents subject to the receipt of the $90.00 transfer fee for each parcel.
BACKGROUND:
In November, 1975, the city acquired the easement rights and pipelines to all of
the S.A.V.I. irrigation facilities within the city. Some of these easements have
been utilized for storm drain and street widening purposes, but the majority of
these easements will not be needed for any public use.
DISCUSSION:
Two property owners have requested the Quitclaim of S;A.V.I. easements which run
along the northerly boundary of their properties. These easements are located as
follows:
17432 Mitcheil Ave. - Gilbert and Anita Ferguson
17442 Mitchell Ave. - Brian J. Hawkins Developers, Inc.
The city has no future use for these easements on Mitchell Avenue. City Council
has previously established a transfer fee in the amount of $90.00 for each
Quitclaim Deed.

Gentlemen:
Our escrow of the above number involves the sale df property
located at 17442 Mitchell, Tustin, Califoria by seller,
Chapin Developers, a California Corporation.
According to the preliminary title report there is an old
Santa Ana Valley Irrigation District easement over said land
which was recorded in the year 1920.
It is our understand the City of Tustin Will cause this easement
to be removed by way of a Quitclaim Deed being.recorded to the
owners of the property, Chapin Developers, a California Corporation.
We enclose a copy of the legal description affecting the property
which, is the subject of our escrow and request a Quitclaim Deed
be prepared for recording.. We will be happy to record same
through our escrow if you wish. Just call this office and we
will pick up the Quitclaim Deed when it is ready.
Gilbert W. Ferguson and Anith J. Ferguson, and/or Mark S. Ferguson
who are the purchasers of the s~bJect property, own the property
adjoining our subject prpperty to the west. They would like a
Quitclaim Deed for this adjoining property. The legal description
for the adjoining property is, Portion of land shown as lots 39
and 40 on the Map of "A part of Tuatin City" as per map recorded
in Book 4, pages 218 and 219 as per complete legal description

In addition to the legal description for our subject property
we are enclosing a page from the preliminary title report which
describ~a~ement for which we need a Quitclaim Deed.
