WICK, ASSISTANT CITY ENGINEER SUBJECT: AUTHORIZATION TO ADVERTISE FOR BIDS FOR "B" STREET HCDA STREET AND STORM DRAIN IMPROVEMENTS RECOMMENDATION: It is recommended that the City Council, at their meeting of October 29, 1984, adopt the attached Resolution approving the plans and specifications for subject project And directing the City Clerk to advertise for bids. BACKGROUND: Subject project encompasses the realignment and construction of street improvements on "B" Street from McFadden Street to 350'+ northerly and construction of a storm drain on "B" Street from Mitchell Avenue ~Nisson Road. This is the first phase of the "B" Street Improvement Project. The second phase will continue the improvements from 350'+-- northerly of McFadden Street to Nisson Road. There is presently $158,000.00 in HCDA funds available for these projects. Another $100,000.00 in HCDA funding is forthcoming within a few weeks. The Engineer's estimate for this first phase is $87,300.00. An estimate for the second phase is not yet available. The Council had allocated $105,000.00 in the '84-'85 Budget for the storm drain which was to be extended westerly on Ntsson Road to the Influential Squre Development. This drain cannot be installed now because of.the freeway widening project. The storm drain being constructed with this project will be utilized by CalTrans to take care of the Influential Square drainage problem. The $158,000.00 figure includes $65,000.00 fn Jobs btll funding. This $65,000.00 must be committed prior to January 1, 1985. Consequently, this project is being fast tracked so that construction will start prtor to January 1, 1985. ' 6 Plans and specifications will only be mailed out upon payment of ? $15.00 per set, which amount shall be non-refundable. 8 'In conformance with Section 37931 of the Government Code, all bids shall be presented under sealed cover on the proposal form provided and 9 accompanied by one of the following forms of bidder's security: 101 a. Cash b. Cashier's check made payable to the City of Tustin. 11 c. Certified check made payable to the City of Tustin. d. Bidder's bond executed by an accredited surety insurer, made 12 payable to the City of Tustin . 13 A Security Bond for payment of labor and materials will be required in the amount of one hundred percent (100%) of the estimated total contract 14 price and a Faithful Performance Bond in the amount of one hundred percent (100%) of the estimated total contract price in the form attached to the 1§ contract documents. Said bonds shall be lissued by a Surety Company rated grade A or better and Class IX or better by the latest edition of Best's 16 Key Rating Guide. 17 City of Tusttn reserves the right to reject any or all bids, and/or waive any informality on a bid. After bids are opened, no bidder may 18 withdraw his bid for a period of thirty (30) days after the date set for I thereof. Prior to bid opening, Bidder may withdraw his bid. the opening 19 Bids received after the bid opening time & date stated herein will be returned to bidder unopened. The contract will be awarded to the lowest qualified bidder no later 21 than November 19, 1984. Because of funding requirements for this project, the contractor will be required to begin work no later than December 17, 22 1984. Provisions of the State Contract Act are not applicable, and 24 prospective bidders will not be required to be prequalified. All work to be done under the direct supervision of ~he City Engineer, 25 City of Tustin. All work to be paid for at the unit prices bid from appropriated 27 monies. Pursuant to California Government Code Section 4590, the contractor 28 will be entitled to post approved securities with the City or an approved financial institution in order to have the City release funds retained by the City to insure performance of the contract. A-3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 The City Council of the City of Tustin has obtained from the Director of Industrial Relations the general prevailing rate of per diem wages and the general prevailing rate for legal holiday and overtime work in the locality in which the work is to be performed for each craft or type of work needed and a copy of the same is on file in the office of the City Clerk. Not less than said prevailing rates shall be paid to workers employed on this public works contract as required by Labor Code Sections 1771 and 1774 of the State of California.
