RECOMMENDATION:

BACKGROUND:
In 1972, the California Legislature enacted into law the NeJedly-Z'berg-Dills
Solid Waste Management and Resource Recovery Act. The Act requires the County, in
cooperation with affected local jurisdictions, to develop a complete, coordinated
solid waste management p~an. Accordingly, under the direction of the Orange
County Board of-Supervisors, the first County Solid Waste Management Plan (CoSWMP)
was written and adopted in 1975, thereby establishing a comprehensive plan for the
efficient and effective management of solid waste.
The need for a Plan revision was recognized by both the State and the County in
1981. The State identified three specific areas requiring revision: update the
Resource Recovery Plan, update the Implementation Plan and add an Enforcement
Plan.
In addition to the State's required revisions, the County determined that the
changes occurring in the County's waste management system since the first Plan was
written in 1975' should be incorporated into the Plan. Many of these changes were
identified by or came about as a result of a study of the total waste management
field ordered by the Board of Supervisors in 1981. Areas of study included
everything from operations and private sector involvement to the viability of
waste-to-energy projects. The document, issued in mid-1982, entitled Solid Waste
Management System .for the County of Orange, served as the reference document for
much of t~is revised plan.
DISCUSSION:
The goals and objectives contained in the Orange County Solid Waste Management
Plan provide for the ability to protect and enhance Orange County's environment
and resources through proper solid waste management and are to be achieved through
the combined efforts and cooperation of relevant governmental agencies, private
industry and the general public.
Tustin has already complied with the basic requirements needed for Plan
implementation through Section 4300 of the Tustin City Code and the current Solid
Waste Collection Franchise Agreement.

Some issues of concern are:
1. The handling of hazardous waste is not addressed in this Plan but will be
submitted as a separate document and be an addendum to this Plan. Given
past proposals for the disposal of hazardous waste, the Council might
prefer to condition the adoption of this Plan with the approval of the
Hazardous Material Plan.
2. The precise involvement of the private sector is not'clearly delineated.
Once again, Council might prefer to condition the adoption of the Plan to
help ensure that local agencies have an active role in determining the
involvement of private industry.
3. The capital and operating costs for resource recovery are not yet
determined. As these processes become feasible, the decision as to who
owns the resource and the energy recovered from same will need to be
addressed.
4. In the near future, all landfills/disposal sites are proposed for the .
south county area while at this time the largest volume of solid waste is
generated in the north east county area. This raises some questions~of
equity.
The Tustin City Council must take action on this PlAn by October 23, 1984.' If no
action is taken, the County will assume approval. Other Orange County cities were
surveyed as to their proposed action. All surveyed cities, where a response was
rendered, were recommending approval except for Irvine.
A Resolution for the adoption of the Orange County Solid Waste Management Plan has
been prepared and attached in the event the Tustin City Council desires this
course of action.

RESOLUTION NO. 84-81
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, ADOPTING THE ORANGE COUNTY SOLID
WASTE MANAGEMENT PLAN
WHEREAS, the City Council is in agreement with the objectives
set for{h in the Orange County Solid Waste Management Plan; and
WHEREAS, the method and/or organization for implementation of
the program is acceptable; and
WHEREAS, procedures for financing the program are in
congruence with City policy; and
WHEREAS, the role identified for the City of Tustin is
}rovided for in Section 4300 of the Tustin City Code;
NOW, THEREFORE, the City Council of the City of Tustin does
hereby adopt the Orange County Solid Waste Management Plan provided:
1. The submitted Hazardous Waste Plan addendum meets with the approval of
the Tustin City Council.
2. Local agencies play an active role in determining the future
involvement of the private sector in the handling of solid waste.
PASSED AND ADOPTED by the City Council of the City of Tustin
at a regular meeting held on the 15th day of October, 1984.
