HomeMy WebLinkAboutCC 8 LEVY RENT INC. 10-15-84CONSENT CAr.RNDAR FROH: COI~IUNITY DEVELOPMENT DEPARTMENT SUBJECT:-- PERJqISSION TO LEVY RENT INCREASE APPLICANT: LOCATION: DAVID JEFFERS 1971REN CIRCLE BACKGROUND: On July 19, 1982, the Planning Agency approved Use'Permit 82-18 authorizing the conversion of a residential duplex unit into a two-unit condomin4um project. As a condition of approval, pursuant to Section 9274 of the Tustin City Code, rents for tenants residing within the complex were "frozen". The City Code further provides that rents may be increased, if such a proposal is approved by the City Council. The Final Tract Map for the conversion was approved on March 5, 1984. DISCUSSION: As evidenced by the attached letter, Mr. David Jeffers is requesting authorization to increase the monthly rent of the only remaining tenant who qualified for the rent freeze. Mr. Jeffers wishes to increase the rent from the 1982 rate of $485.00 to $640.00 per month. In a report to the Council on October 1, 1984 the Community Development Department considered that the amount of increase requested by Mr. Jeffers may have been constituted a hardship upon the tenant. However, at the recommendation of the City Attorney, the current rental rate in the area was examined. On information received from other property owners in the area, the rent for other units, with the same floor plan as 1971 A Ren, ranges from $650.00 to $675.00 per month, and possibly as high as $700.00. City Council Report October 15, 1984 page two RECOI~£NDATION: Based on the rent rates in the area and the fact that the unit has been upgraded in compliance with the adopted condominium conversion standards, it is recommended that the rent increase as requested by Mr. Jeffers be approved by minute order. As the Condo Conversion is now complete, I am requesting that the rent "freeze" on the applicable unit(s) be removed. Because the Real Estate market is unfavorable for a sale-transaction at this time, I shall re- sume the rental program that was in effect prior to my request to convert to condominiums. I understand, from talking with the City Attorney's Office,. that this procedure is in compliance with the intent of the City's OrdiHance.
