HomeMy WebLinkAboutRPT 3 AMEND GEN'L PLN 10-1-84FROM: S Wad ECT: HONORABLE MAYOR AND CITY COUNCIL COI~4UN]TY DEVELOPMENT DEPARTMENT FIXED OATES TO AHENO THE TUSTIN AREA GENERAL PLAN DISCUSS ION: In accordance with Section 65361(a) of the Government Code, general law cities can amend their general plans a total of four times in one calendar year. Although a city can amend the general plan at only four times each year, it can consider mere than one amendment at each of the four times. Many cities and counties in California usually establish four times during the year in which the general plan can be amended, and lump several amendments as one project at each time. In that way, applicants know specifically when the general plan is being amended, and when their requests must be filed and can be heard in a public hearing. In previous years, the City of Tusttn has not been faced with numerous requests to amend the Tustln Area General Plan 'and a policy of this detail was not needed. However, this year has seen several request from applicants along with public hearings on amendments to three elements of the General Plan. This has resulted in lumping amendments' together and in one case, caused an applicant a delay in his entitlement process due to the uncertainty of when his proposed amendment could be placed on the agenda. Although this year's situation can be considered unusual, next year will see at least four amendments to the General Plan at various times. In order to efficiently and effectively deal with these amendments and others that may be proposed, staff is recommending a policy that establishes four specific times each calendar year that the General Plan can be amended. This policy will accomplish the dual purpose of informing applicants of specific times their proposals can be heard, and allow the city to lump several amendments at once.
