(R-4) DISTRICT CHANGE THE SUBdECT PROPERTY ZONING FROM R-4 iSUBURBAN RESIDENTIAL) TO CG (PUD), COMMERCIAL GENERAL - PLANNED UNIT DEYELOPMENT BACKGROUND: The subject property is a 4.2 acre site located on the corner of Walnut Avenue and Red Hill Avenue. It presently has one single-family home which is surrounded by fruit trees. The property has a General Plan Land Use designation of Commercial. The City Council adopted this'designation at its July 10, 1984 meeting, changing it from a Professional Office (PR) designation. The Planning Commission recommended the change to Commercial at its meeting of June 24, 1984. According to State Statutes, the authorized General Plan Land Use designation and the City's zoning ordinance must be in conformance. Since the property has a residential zone, R-4, a change to a commercial zone district is mandatory in order to match the commercial land use designation. The Planning Commission adopted Resolution No. 2171 at its regular meeting of August 13, 1984, recommending a zone change to Commercial General - Planned Unit Development, CG(PUD) to the City Council. A CG(PUD) should provide sufficient development control by requiring a Use Permit for any project proposal. Enactment of the Commercial General - Planned Unit Development zone will bring both the zoning district and General Plan Land Use into conformance. The City Council of the City of Tustin does hereby ordain as follows: I. The City Council finds and determines as follows: That a proper application, (Zone Change 84-5) has been filed bY Matt Ntsson, to change the zone for 14462 Red Hill Avenue from Suburban Residential District (R-4) to Commercial General - Planned Unit Development District (CG-PUD) as indicated on Exhibit "A". B. That a public hearing was duly called, notice and held on said application. C. That a zone change should be granted for the following reasons: 1. The proposed zone designation will bring the subject property in conformance with the Tustin Area General Plan. The Planned Unit Development designation will provide greater review authority of any proposed development for the property. ~ A Negative Declaration has been filed in conformance with. the requirements of the California Environmental Quality Act, and is hereby adopted. Development of subject property shall be in accordance with the policies adopted by the City Council; Uniform Building Codes as administered by the Building Official; Fire Code as administered by the Orange County Fire Marshal; and street improvement requirements as administered by the City Engineer. That the Planning Commission adopted Resolution No. 2171 at its regular meeting of August 13, 1984 recommending that the City Council adopt a zone designation of Commercial General - Planned Unit Development, CG (PUD) for the subject property. DISCUSSION: In reviewing the City's Commercial districts, it is Staff's intention to recommend a district that provides the owner with design and land use flexibility, while affording privacy and design co~atible with adjoining residents. The Commercial General - Planned Unit Development (CG-PUD) district should provide that flexibility by requiring a Use Permit for any proposed project. The Commission will be able to review issues in a public forum, and determine if the proposed project is compatible with adjacent developments. A Use Permit also allows staff greater input into proposed projects, in order to alleviate project issues early-on. The CG-PUD district permits most commercial uses, along with professional offices.
