HomeMy WebLinkAboutCC 6 RELINQUISH RAMPS 09-04-84 CONSENT CALENDAR NO. 6 DATE: AUGUST 24, 1984 FROH: SUBJECT: WILLIAM HUSTON, CITY MANAGER BOB LEDENDECKER, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER RELINQUISHMENT OF NORTHBOUND 07-0RA-55 MCFADDEN AVENUE ON-OFF RAMPS EXTENSION BETWEEN PASADENA AVENUE AND NEWPORT AVENUE - FILE #881 RECOMMENDATION: That the Tustin City Council, at their meeting of September 4, 1984, pass and adopt the attached Resolution requesting relinquishment of the northbound 07-0RA-55 McFadden Avenue on-off ramps between Pasadena Avenue and Newport Avenue ' and waiver of ninety(90) day notice of intention. BACKGROUND: The northbound Costa Mesa freeway on-off ramps for McFadden Avenue were constructed by CalTrans and have been maintained by that agency since the construction of the freeway. These ramps extend easterly from the Costa Mesa freeway through the intersection at Pasadena Avenue to Newport Avenue. The portion upon which the City is requesting relinquishment lies between Pasadena Avenue and Newport Avenue and as shown in red on the attached map. DISCUSSION: The City has been attempting to install a traffic signal at the intersection Of Newport Avenue and Sycamore Avenue. The westerly leg of the intersection (Sycamore Avenue) is currently under the jurisdiction of CalTrans which precludes any construction within the intersection without their approval. The City has requested to install a traffic signal controller at that intersection of the type that has been previously installed along Newport Avenue northerly of the freeway and throughout the City. CalTrans has not and will not approve this type of controller within any intersection within their jurisdiction. The only type of controller allowed by CalTrans is a Type 170 which is not compatible with the City's system and will not respond to an interconnect system such as proposed with the City's upcoming Newport Avenue F.A.U. Interconnect Project along the southerly portion of Newport Avenue. AUGUST 24, 1984 PAGE 2 Staff is 'requesting relinquishment of CalTrans jurisdiction to the westerly leg of Sycamore Avenue between Pasadena Avenue and'Newport Avenue. The attached Resolution requests this relinquishment as well as a waiver of the ninety(90) day notice of intention to relinquish. This waiver will hopefully expedite the process of relinquishment. This relinquishment will cause the City to be responsible for all pavement and landscape maintenance within the area of relinquishment. Landscape maintenance by CalTrans in years past has been less than desirable. Bob Le~ende6ker Director of Public Works/City Engineer BL:jr Attachment cc: Jim Kawamura RESOLUTION NO. 84-70 1 2 5 6 7 8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REQUESTING RELINQUISHMENT OF THE EXTENSION OF THE NORTHBOUND 07-0RA-55 MCFADDEN AVENUE ON-OFF RAMPS BETWEEN PASADENA AVENUE AND NEWPORT AVENUE AND WAIVER OF NINETY (90) DAY NOTICE OF INTENTION WHEREAS, by Freeway Agreement dated September 22, 1958, between the County of Orange and the State of California, the State of California has constructed certain local roads lying, at that date, within an unincorporated area in said County and the County has agreed to accept title to same upon relinquishment by the State of California; and WHEREAS, the above mentioned facilities now lie within the City of Tustin; and 9 WHEREAS, the State of California has acquired right of way for I)and has constructed the extension of the northbound 07-0RA-55 McFadden Avenue 10 on-off ra~s between Pasadena Avenue and Newport Avenue in accordance with said Agreement; and 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the Tusttn City Council has found and determined, and does hereby find and determine that it is desirable and in the public interest that said extension of the access ramps between Pasadena Avenue and Newport Avenue be relinquished to the City of Tustin for use as a City street subject to the reservation to the State of California any and all rights of ingress to and egress from the highway hereby relinquished in and to the adjoining freeway, except at such points as may be established by Resolution of California Transportation Commission; and WHEREAS,. the City of Tustin is aware of the ninety (90) day notice in writing of intention to relinquish any portion of a State highway as required by Section 73 of the Street and Highway Code and requests waiver of said notice for above mentioned relinquishment; NOW, THEREFORE, IT IS RESOLVED, by the City Council of the City of Tustin requests that the State of California proceed with the above mentioned relinquishment to the City of Tustin and that the ninety (90) day notice in writing per Section 73 of the Street and Highways Code by waived in order that this relinquishment proceedings may be accelerated. BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized and directed to transmit to the State of California Department of Transportation a certified copy of this Resolution.
