HomeMy WebLinkAboutCC MINUTES 1958 06 16 MINUTES OF A REGULAR MEETING OF THE TUSTIN CITY COUNCIL, JUNE 16, 1958 COUNCILMEN PRESENT: Kidd, Tadlock, Humeston, Bacon & Byrd. ABSENT : None. PRESENT : Dennis D. Hayden. Meeting was called to order by Mayor Jerome C. Kidd at 7:40 P.M. On motion of Councilman Tadlock, seconded by Councilman Humeston and carried, minutes of the regular meeting of June 2, 1958 were approved as mailed, and the minutes on the regular adjourned meeting of June 13, 1958 were approved as read. HOLTHE A letter from the Holthe Disposal Service was read which DISPOSAL stated that the present contract for trash and garbage CONTRACT services terminated as of June 30, 1958. Mayor Kidd appointed Councilman Byrd, Humeston and himself a committee to discuss renewal of the above contract. Mayor Kidd was authorized to extend the present contract PRESENT for at least a period of thirty days or until a new one CONTRACT could be agreed upon with the Holthe Disposal Service, EXTENDED upon motion of Councilman Tadlock seconded by Councilman FOR 30 Humeston and carried unanimously. DAYS. A letter from the Tustin Chamber of Commerce, dated June 13, 1958 was read and upon motion of Councilman Tadlock, seconded by Councilman Byrd and carried, was ordered received and filed. Action on the letter from the Tustin Area Youth Center, TUSTiN requesting assistance from the city in the removal of YOUTN CENTER Eucalyptus trees from the South side of West Sixth REMOVAL OF Street, the site of the proposed Youth Center, was TREES deferred until later in the meeting. The hearing on the re-zoning of the "Preble Property" was opened by Mayor Kidd. RE-ZONING A letter from Mrs. Esther A. Gillespie owner of adjacent ON PREBLE property was submitted, in which she stated that she had PROPERTY no objection to the re-zoning but requested the developer install a chain link fence as a protective measure to her property. Mr. Ross Shafer, owner of an orange grove immediately to SHAFER the North also requested a fence as a protection to his REQUEST FOR property. FENCE. Mr. F. W. Sallee, representing New Homes, Inc., developers of the Preble property stated that his company did not feel SALLEE that it was feasible to construct such a fence; that the & CO. POLICY cost far out-weighed the benefit, but that damage to any property adjacent to one of their projects caused by their employee's, had always been promptly taken care of and they intended to continue that practice in the future. PREBLE There being no further discussion from the floor the FENCE hearing was declared closed. The matter of requirin~ the fence as a condition to re-zoning was discussed bY the Council. City Attorney Hayden stated that in his opinion the requirement to construct a fence as a condition to re-zoning would not hold ~n a court of law. ORD. 116 First Motion of Councilman Bacon, seconded by Councilman Reading. Tadlock that ORDINANCE NO. 115 have its first reading in its entirety. Motion carried, all Councilmen voting Aye. APPROVAL Motion of Councilman Tadlock, seconded by Councilman ON LEASE Byrd that the agreement between New Homes, Inc., and AGREEMENT the City of Tustin, dated June 16, 1958 be approved. NEW HOMES Motion carried. The final map for Tract No. 2187 was presented to the Council For action by John H. Siegel in the absence of City Engineer McBride who before leaving on vacation certified said map. TRACT 2187 Motion of Councilman Tadlock, seconded by Councilman GIVEN Bacon that Tract Map No. 2187 be approved and the FINAL City Cleck authorized to certify to the map and the APPROVAL dedication thereon. Motion carried. Motion of Councilman Tadlock, seconded by Councilman PERFORM- Humeston that the performance Bond by New Homes, Inc., ANCE BOND for Tract No. 2187 be received and filed. Motion NEW HOMES carried. TUSTIN The matter of tree removal at the site of the Tustin YOUTH Area Youth Center was again brought up. On motion of CENTER Councilman Tadlock, seconded by Councilman Byrd and TREE carried unanimously, it was agreed that the City of REMOVAL Tustin would allow $500.00 towards removing the trees in question, at the Tustin Area Youth Center site. Motion of Councilman Humeston, seconded by Councilman Byrd that Mayor Kidd and the City Clerk be authorized to execute a Lease Agreement between the City of Tustin and The Tustin Area Youth Center, Inc. Motion carried. MAYOR KIDD Mayor Kidd asked and was granted permission to leave LEAVE the state for two weeks on motion of Councilman Bacon, OF ABSENCE seconded by Councilman Humeston. RESOLU- Motion of Councilman Bacon, seconded by Councilman Byrd TION NO. that RESOLUTION NO. 442, calling a hearing for zoning 442 the proposed Greater Tustin Annexation, be adopted. Motion carried, all Councilmen voting Aye. Motion by Councilman Humeston, seconded by Councilman FIRECHIEF Tadlock that Firechief Lindsay or someone designated LINDSAY by him, make a city wide inspection for fire hazards and that he be compensated for his services. Motion carried. Motion of Councilman Humeston, seconded by Councilman EMPLOY- Tadlock that City Clerk A. O. Park be authorized to MENT OF employ whatever competent help and services necessary HELP ON to comply with all the legal requirements and procedures G.T. pertaining to the proposed "Greater Tustin Annexation." ANNEX. Motion carried. Motion of Councilman Bacon, seconded by Councilman Tadlock that the bills be paid. Motion carried. A. O.
