HomeMy WebLinkAboutCC 8 USE PERMIT 84-8 08-20-84 3 4 5 6 7 8 9 10 11 12 14 16 17 19 2O 22 23 27 RESOLUTION NO. 84-62 CONSENT CALENDAR NO. 8 8-20-84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN CALIFORNIA, ACTING ON AN APP£AL OF THE CITY COUNCIL AFFIRMING THE FINDINGS OF THE PLANNING COMMISSION CONCERNING USE PERMIT NO. 84-8 The City Council of the City of Tustin, California does hereby resolve as follows: I. The City Council finds and determines as follows: A. That a proper application (Use Permit No. 84-8) was filed on behalf of First Orange County Sidhaland requesting authorization for 18 additional apartments at 13181-13195 Gwyneth Drive. B. That a Public Hearing was duly called, noticed and held on the said application. C. That the Planning Commission of the City of Tustin, by Resolution No. 2155 did approve said use permit application with authorization to develop additional apartment units in conjunction with site improvements on land previously used as a railroad right-of-way. D. That the City Council, at their meeting of May 21, 1984, by a vote of three ayes to zero noes, appealed the decision of the Planning Commission pursuant to City Code Section g2g4b. F. That the City Counmcil determined that the findings and conclusions of the Planning Commission were correct and the conditions of approval were appropriate to mitigate negative environmental impacts. I1. The City Council of the City of Tusttn does hereby affirm the findings of the Planning Commission as contained in Resolution No. 2155, subject to the following conditions: A. That the total number of units be reduced from 18 as initially requested to 12 units within two buildings. B. That the building height shall be limited to two (2) stories. C. That written verification shall be provided by the fuel pipeline owner that all requirements of the pipeline easement have been complied with on the proposed project. D. That the applicant shall provide the City with proof of ownership of the railroad land area. E. That the second floor windows which face the single family homes to the north shall be fitted with permanent screens which will obscure the view into the rear yards of the single family area. 1 3 4 5 6 7 8 9 10 11 13 14 15 16 17 18 19 20 21 22 23 25 27 That Increased tree plantings along the property line boundary between the proposed project and the single family homes to the north shall be required.
