RESOLUTION OF CONFIRRRTION OF MASTER TAX AGREEMENT FOR PROPOSED
GYLAH-#ARREN ANNEXATION NO. 134
RECOI~ENDED ACTION:
Adoption of Resolution No. 84-46 confirming the application of the Master
Property Tax Transfer Agreement to the proposed Gylah-Warren Annexation No. 134
to the City of Tustin.
BACKGROUND:
An application for annexation to the City of Tustln has been filed with the
Local Agency Formation Commission by Bill Burk, 14582 Gylah Lane.
Section 99(d) of the Revenue and Taxation Code requires the City and County to
approve the exchange of property tax revenues prior to consideration of the
application-by LAFCO.
DISCUSSION:
Approval of Resolution No. 84-46 does not imply approval of the annexation and
is a procedural act prior to consideration by the Local Agency Formation
Commission. Approval' of the annexation by the City Council should be contingent
upon a revision of the boundaries of the proposed annexation to delete the
property on Greenwood Lane, which cannot be conveniently provided City services.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, CONFIRMING THE APPLICATION OF THE MASTER
PROPERTY TAX TRANSFER AGREEMENT TO THE PROPOSED GYLAH-
WARREN ANNEXATION NO. 134
WHEREAS, a MASTER PROPER~ TAX TRANSFER AGREEMENT BETWEEN THE
COUNTY OF ORANGE AND THE CITY OF THSTIN TO PROVIDE FOR PROPERTY TAX
EXCHANGE IN AREAS ANNEXED BY THE CITY dated October 28, 1980, has
been executed by the Board of Supervisors of Orange County and the
Ctty Councll of the Ctty of Tustln providfng for dtvtsfon of
property taxes pursuant to Section gg(d) of the Revenue and Taxation
Code of the State of California; and
WHEREAS, the property owner has filed a proposal with the Local
Agency Formation Commission for the annexation of the territory
known as Gylah-Warren Annexation No. 134;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Tustin that the MASTER PROPERTY TAX TRANSFER AGREEMENT BETWEEN
THE COUNIT OF ORANGE ANO THE CITY OF TUSTIN TO PROVIDE FOR PROPERTY
TAX EXCHANGE IN AREAS ANNEXED BY THE CITY providing for the
allocation of property tax revenues, as approved by the Board of
Supervisors and the City Council and entered into on November 18,
1980, shall be applicable to the territory within the proposed
Gylah-Warren Annexation No. 134 to the City of Tustin as
substantially developed property.
PASSED AND ADOPTED at a regular meeting of the Tustin City
Council held on the day of , 1984
