TUSTIN CITY COUNCIL, MONDAY, OCTOBER 28th,
1957.
COUNCILMEN PRESENT: Kidd, Tadlock, HUmeston, Bacon & Byrd.
COUNCILMEN ABSENT: None.
CITY ATTORNEY: Dennis D. Hayden, present.
Meeting was called to order at 6:40 P. M. by Mayor Kidd.
The hearing was immediately opened on the proposed
Samuel Tustin Annexation to Tustin."
BUILDING AND A letter with map attached was introduced stating the
LINE SET- recommendations of the Tustin Planning Commission as
BACKS to Zoning and Building Line setbacks for the proposed
Annexation.
The following owners of real property within the proposed
annexation had filed written protests prior to 6:30 P. M.
Martin Bowman, The Southern Pacific Railway Co., H. E.
WRITTEN Balmer, R. P. Bucknet and Paul A. Andtee. Dewey Callahan,
PROTESTS The Inland Lumber Co., The Rusco Co., The Santa Ana-
SAMUEL TUSTIN Tustin Mutual Citrus Association, owners of unsecured
personal property, also filed written protests. City
Attorney Hayden ruled that anyone desiring to withdraw
his protest prior to the close of the hearing, could do
so.
Attorney C. Arthur Nisson, Jr. representing the Mullin
OPPOSITION Lumber Co., tentative purchaser of Mr. Balmer's property,
ON stated that it would be satisfactory with his client,
ZONING. if a distance of 75 feet on Laguna Road from the Bowman
property were zoned C-2, the balance to be zoned M-1.
Mr. Gilbreath and Mr. Elsner and others spoke at some
length against M-1 zoning for any portion of the proposed
annexation.
A representation of the Market Basket Corporation stated
that the zoning and setbacks as recommended by the
Planning Commission would be satisfactory with his
company.
ACCEPTANCE Motion of Councilman Tadlock, seconded by Councilman
OF PLANNING Bacon that the Tustin City Council accept the recommen-
COMMISSION ON dations of the Tustin Planning Commission for Zoning and
BUILDING LINE Building Line setbacks, conditional on annexation and that
SETBACKS. they be incorporated in the Ordinance of Annexation.
Motion carried.
CLOSING OF There being no move by anyone present to withdraw his
PUBLIC protest to the Annexation, the Public Hearing was declared
HEARING closed.
Motion of Councilman Byrd, seconded by Councilman Tadlock,
that in as-much as owners of more than 50% of the real

TUSTIN ANNEX- that the annexation proceedings be terminated and an
ATION Ordinance to that effect be prepared by the City Attorney.
Motion carried.
APPROVAL On motion of Councilman Byrd, seconded by Councilman
ON Tadlock and carried, minutes of the previous meeting were

PREVIOUS
MEETING. A letter from Lester E. Shaw, owner of the "Holiday Cafe"
at 505 West First Street, Tustin, was read, requesting
REQUEST ON that he be granted a dance permit. The letter was ordered
DANCE PERMIT referred to Chief of Police Johansen for recommendation.
City Engineer McBride reported on a proposal by the County
PAVING OF of Orange to pave the City's portion of Newport Avenue
PORTION and recommended that it be accepted.
NEWPORT
Motion of Councilman Byrd, seconded by Councilman Tadlock
RESOLUTION that RESOLUTION NO. 42, " A Resolution of the City Council
NO. 424, of the City of Tustin, to the Board of Supervisors of the

Tustin," be adopted. Motion carried, all Councilmen
voting Aye.
REQUEST Motion by Councilman Bacon, seconded by Councilman Humeston,
FOR that the sponsors of the F. F. A. Barn Dance, Tustin Union
BANNER AT High School, be allowed to install a banner across Laguna
H.S. Road providing that it be installed by a comptent contractor.
Motion carried.
On motion of Councilman Tadlock, seconded by Councilman
Humeston and carried, the bills were ordered paid.
