HomeMy WebLinkAboutCC 3 OPPOSING H.R. 4103 5-7-84 1 3 4 5 6 7 8 9 10 12 13 14 15 17 18 19 20 21 22 23 25 26 27 28 CONSENT CALENDAR NO. 3 5-7-84 RESOLUTION NO. 84-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, OPPOSING H.R. 4103 (Cable Television) WHEREAS, H.R. 4103 has been introduced in the House of Representa- tives of the Congress of the United States; and WHEREAS, H.R. 4103 regulates the contractual relationship between a city and any cable television operator providing cable television service in a city; and WHEREAS, City of Tustin has heretofore awarded franchises to United Cable of Southern California, Ltd. and Community Cablevision; and WHEREAS, the franchises constitute an agreement between City of Tustin and United Cable of Southern California, Ltd. and Community Cablevision; and WHEREAS, H.R. 4103 will orevent City of Tustin from receiving the benefit of the franchise agreements which it bargained for in good faith with United Cable of Southern California, Ltd. and Community Cablevision and will constitute a substantial intrusion by the federal government into. local affairs: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TUSTIN THAT: 1. The City Council of the City of Tustin hereby expresses its opposition to H.R. 4103 because it will prevent City of Tustin from receiving the benefit of an existing franchise agreements negotiated in good faith between City of Tustin and United Cable of Southern California, Ltd. and Community Cablevision. 2. That H.R. 4103 constitutes a substantial intrusion by the federal government into local affairs of cities; and 3. The Mayor of the City of Tustin is hereby authorized and directed to send this Resolution to me~ers of the House of Representatives and to take such other and further action as in necessary to implement this Resolution. Hoesterey City of Tustin Main at Centennial Tustin, CA 92680 Subject: ER 4103, Cable Television Dear Ronald: The Fountain Valley City Council, at its meeting on March 20, 1984, adopted the enclosed resolution op?osing the passage of HR 4103 concerning cable television. - As you are aware, the passage of this legislation would void contracts that any city has negotiated that was fair to both the city and the cable company. In the.case of Fountain Valley, which is one of four cities represented by the Public Cable Television Authority, the passage of this bill would void a major portion of the contract which would result in the loss of millions of dollars to the City of Fountain Valley.
