SENIOR CENTER.CONSULTANT CONTRACT
RECOMMENDATION:
Approve the Senior Center Consultant Contract in the amount of $5,000
and authorize the Mayor and City Clerk to sign the agreement. The City
Attorney had reviewed the agreement and approved it as to form.
BACKGROUND:
The Steering Committee for a Senior Center has been meeting for several
months with Mayor Ursula Kennedy and Councilman Ron Hoesterey to develop
a proposal for a senior Citizens Center in Tustin. A ~ogress report from
the Committee was presented to the City Council at i~s!March 5, 1984
meeting.
The City Council set aside revenue sharing funds to hire a professional
consultant to provide design and development services to the committee
in the 1983-84 budget. Several leading architectural design and develop-
ment firms with extensive backgrounds in senior center development were
invited to submit proposals.
Recreation Systems Incorporated was selected to conduct the research, design
and development work with the Steering Committee for a Senior Center. Pre-
liminary time lines indicate that initial.design concepts will be completed
by the end of/S~mmer.

AGREEMENT
THIS AGREEMENT, made and entered into by and between CITY OF TuSTIN, county
of Orange, State of California, as of this 7th day of May, 1984, by and
between the CITY OF TUSTIN, a Municipal Corporation of the State of
Cali forni a, herei halter cal 1 ed "CITY", and RECREATION SY STEMS,
INCORPORATED, 2500 E. Nutwood Ave., Suite 210, Fullerton, CA 92631, a
California Corporation, hereinafter called "RECREATION PLANNER".
WITNESSETH
WHEREAS, CITY desires to employ a recreation planning firm to furnish the
necessary planni'ng and design services for the design and development of
Tustin Senior Citizens Center in the CITY OF TUSTIN which shall hereinafter
be referred to as the PROJECT;
WHEREAS, RECREATION PLANNER has indicated its willingness to furnish said
planning and design services to the CITY;
NOW, THEREFORE, CITY agrees to employ and does hereby employ RECREATION
PLANNER to provide technical services for the PROJECT, and CITY and
RECREATION PLANNER, for the consideration hereinafter set forth, agree to
as follows:
I
DEFINITIONS_
1. CITY COUNCIL shall mean the City Council of the CITY OF TUSTIN, a
Municipal Corporation.
2. CITY shall mean the CI~ OF TUSTIN, a Municipal Corporation.
3. RECREATION PLANNER shall mean RECREATION SYSTEMS, INCORPORATED,
2500 E. Nutwood Ave., Suite 210, Fullerton, CA 92631.
4. PROJECT shall mean the design and program development of a Senior
Citizens Center, location to be determined at a future time.
5. PROGRA~I DEVELOPMENT shall mean that portion of the design process
that establishes ultimate scope, functional requirements and
arrangements of facilities in the PROJECT, and includes cost
estimates and a recommended implementation program.

SCOPE OF RECREATION PLANNER'S SERVICES
RECREATION PLANNER agrees to prepare and furnish to CITY,
following receipt of written authority to proceed, a final
document, functional standards, space relationships for
structural improvements, cost estimates and a recommended
implementation program.for the PROJECT. These services shall
include, but are not limited to, the following:
A. PHASE I - PROGRAM DEVELOPMENT
~1) Review scope and project intent with CITY staff and
others as directed;
(2) Review existing senior programs, needs, and available
resources;
(3) With staff, establish a planning schedule and programs
that will assure maximum involvement by staff and the
Seniors Advisory Committee in the decision-making
process;
(4) Meet and confer with staff and Seniors Advisory
Committee to determine functional needs and space
requirements of proposed use areas;
(5) Prepare a series of conceptual floor plans of the
proposed seniors' facility for review and discussion
with staff and Seniors Advisory Committee;
(6) Prepare an interim report outlining functional
requirements of facility and defining recommended scope
for review, adjustment, and approvals as directed;
(7) Prepare a conceptual plan incorporating comments and
approved changes rendered for public presentation;
(8) Prepare final narrative report including development
program, rationale for establishing scope, functional
requirements of individual elements, cost estimates,
and an assessment of any anticipated environmental
impacts;
(9) Presentation of final report and plan to CITY COUNCIL
and others, as directed.

SCOPE OF CITY'S SERVICES
CITY agrees to furnish to RECREATION PLANNER or at CITY's
discretion, shall reimburse RECREATION PLANNER for the actual
cost plus 2% of providing the following information to assist it
in rendering the services set forth in ARTICLE II of this
AGREEMENT:
A. Existing senior citizen program information and
requirements.
Current census information on the senior population in the
City of Tustin and projections for future population
distributions.
Ownership and information on possible Senior Center
locations, boundaries, and sizes.
IV
TIME FOR COMPLETION
It is hereby understood and mutually agreed that the time for completion of
the work to be performed by the RECREATION PLANNER is an essential
condition of this AGREEMENT. The RECREATION PLANNER agrees that it shall
prosecute regularly and diligently the work of this AGREEMENT according to
reasonable schedules established by CITY for various items of work
described in ARTICLE II. The CITY agrees to provide required reviews and
approvals within a reasonable period following each submission. RECREATION
PLANNER shall not be accountable for delays in the progress of its work
caused by any condition beyond its control and without the fault or
negligence of the RECREATION PLANNER.
V
COMP EN SAT I ON
The compensation to be paid unUer this AGREEMENT shall be as
follows:
A. RECREATION PLANNER agrees that the services to be performed
by it pursuant to this AGREEMENT shall be performed for the
lump sum fee of Five Thousand Dollars ($5,000.00).
B. Payment of said compensation shall be as follows:
(1) Two Thousand Five Hundred Dollars ($2,500.O0)'upon
approval of the interim report outlining functional
requirements of the facility and defining recommended
scope for review;
(2) Two Thousand Five Hundred Dollars ($2,500.00) following
approval of final report.
VI
MISCELLANEOUS PROVISIONS
1. CITY and RECREATION PLANNER further agree to the following

conditions:
A.
CITY, by notifying RECREATION PLANNER in writing, shall have
the right to terminate any or all of the services and work
covered by this AGREEMENT at any time. In the event of such
temrmination, RECREATION PLANNER agrees to submit its final
written statement of the amount of its services outstanding
as of the date of such termination.
B. RECREATION PLANNER agrees that it shall proceed immediately
and diligently to perform the services provided for in this
AGREEMENT upon receipt of notice from CITY to proceed
therewith.
C. The terms and provisions of this AGREMENT shall extend to
and be binding upon and inure to the benefit of the heirs,
executors, administrators, successors, and assigns of the
respective parties hereto.
D. RECREATION PLANNER shall perform the services hereunder-as
an independent contractor and under no circumstances or
conditions shall any agent, servant, or employee of
RECREATION PLANNER be considered as an employee of CITY.
E. RECREATION PLANNER shall perform all services required under
this AGREEMENT in a careful, diligent and professional
manner and shall be responsible for all errors and omissions
for services performed by it under the terms of this
AGREEMENT.
F. RECREATION PLANNER shall carry and pay for such compensation
insurance as is necessary to fully project RECREATION
PLANNER and its employees under California Workers'
Compensation Insurance and Safety Laws, to relieve CITY from
all responsibility under said laws in connection with the
performance of this AGREEMENT, and upon the execution of
this AGREEMENT to file with CITY a certificate certifying to
said protection.
G. RECREATION PLANNER certifies that there shall be no
discrimination against any employee who is employed in the
work covered by this AGREEMENT or against any applicant for
such emplo~qnent because of race, religion, color, sex, or
national origin, and such non-discrimination shall include,
but not be limited to, the following: employment,
upgrading, demotion or transfer, recruitment or recruitment
advertising, layoff or termination, rates of pay or other
forms of compensation, and selection of training, including
apprenticeship.
IN WITNESS WHEREOF, the CITY OF TUSTIN, a Municipal Corporation, has caused
this AGREEMENT to be executed in duplicate by its Mayor and attested by its
City Clerk under authority of a motion adopted by the Council of the CITY
OF TUSTIN on the 7th day of May, 1984, and RECREATION PLANNER have caused
this AGREEMENT to be executed.
