NO. 10 DATE: APRIL 30, 1984 TO: FROM: SUBJECT: WILLIAM HUSTON, CITY MANAGER HUGH WEST, MAINTENANCE SUPERINTENDENT CITIZEN REQUEST FOR TREE REMOVAL RECOMMENDATION: That the tree at 14831 Branbury Circle be removed under provisions of Section II of the current City Tree Removal Policy. BACKGROUND: In 1983, Mr. & Mrs. Lehrer complained of the roots'of their parkway tree were all on top of the ground. The City tree crew cut the top back and prunned the roots above ground. Mr. & Mrs. Lehrer now request the City remove the tree. The current City Policy is as follows: When a tree is one of the trees currently on the City approved tree list and the property owner complains of extensive litter or wants the tree removed for some other problem, the City will remove the tree at City expense and replace it at the property owners expense for labor, materials, and replacement tree selected from the approved tree list. Mr. & Mrs. Lehrer have been offered this option, they indicate however, that they have no desire to have a tree in the parkway. DISCUSSION: The tree is a Laurel and seems to be doing fine after root prunning. Mr. & Mrs. Lehrer complain of a small crack in the sidewalk and they have been informed that the City will repair sidewalks, curb, and gutter where damage has occured from a City parkway tree. Tustin, CA 92680 Dear Mr. & Mrs. Lehrer: I am sure that I stated to you last year the the City is responsible for replacing the sidewalk when damaged by a parkway tree. The City has not decided to remove all parkway trees because of this problem. Whatever kind of tree is in the parkway or trees on private property, if they are within 6 to 8 feet of the sidewalk, will do damage before they reach maturity. If you wish some other type of tree that is on the City approved list, the City will remove the one you have at city expense provided you will pay the cost for the replacement tree plus planting costs. Please find the City tree list enclosed. Since the removal of this tree will effect the environment in which you live, we solicit your comments. If you object to the removal, please respond in writing within ten (10) days~after receipt of this letter. If we have not heard from you in that time, we will assume you haYe no objections to the removal.
