O. - That Ordinance No. 910 be passed and adopted. {Roll Call Vote) 1 2 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 ORDINANCE NO. 910 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE RE-ZONING OF THE PROPERTY LOCATED AT 17361 MCFADDEN AVENUE FROM MULTIPLE-FAMILY RESIDENTIAL (R-3) DISTRICT TO RETAIL COMMERCIAL (C-1) DISTRICT The City Council of the City of Tustin does hereby ORDAIN as follows: I. The Ci'ty Council finds and determines as follows: A. That a proper application, (Zone Change 84-1), has been filed by the City of Tustin, for a zone change from Multiple-Family Residential (R-3) District to Retail Commercial (C-1) District for the property described in Exhibit "A" attached hereto and incorporated herein by this reference as though set forth herein in full. B. That a public hearing was duly called, noticed and held on said application. C. That a zone change should be granted for the following reasons: 1. The Retail Commercial District is in conformance with the commercial land use designation of Tustin Area General Plan. 2. The Retail Commercial District designation will bring this parcel into conformance with the uses authorized under Use Permit 84-1. D. Development of subject property shall be in accordance with the policies adopted by the City Council; Uniform Building Codes as administered by the Building Official; Fire Code as administered by the Orange County Fire Marshal; and street improvement requirements as administered by the City Engineer. E. Final development plans shall require the review and approval of the Community Development Director. F. That a Negative Declaration was previously approved to comply with the requirements of the California Environmental Quality Act. 1 3 4 5 6 7 8 9 10 11 19. 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Ordinance No. 910 Page 2 II. The City Council hereby approves Zone Change 84-1 for the above described property (Exhibit "A") from Multiple-Family Residential (R-3) District to Retail Commercial (C-1) District.
