FROH: SUBJECT: Honorable Mayor & Members of the City Council Community Development Department Zone Change 84-1 Applicant: Location: Request: Mary Ann Barker, initiated by the Tustin Planning Commission 17361 McFadden Avenue To change the zone designation from the existing Multiple-Family (R-3) District to the Retail Commercial {C-1) District Background & Discussion The subject property, which was part of Annexation No. 120, was annexed to the City on June 4, 1979. In 1982, the two property owners to the west (17311 and 17341 McFadden Avenue) requested and received a change of zone from the Multiple-Family (R-3) to Commercial General-Planned Unit Development (CG-PUD) District. At that time, the owner of this parcel was not interested in changing the zone.. On FebruaFy 27, 1984, the Planning Commission approved Use Permit 84-1 which authorized the use of this parcel as a parking lot for a retail commercial shopping center on the adjoining lot at 14311 Newport Avenue. The land use designation for this parcel is commercial and a condition of the use permit approval was that the new owner agree to bring the zoning into conformance with the Land Use Element'of the Tustin Area General Plan. The property easterly of this small parcel on 14311 Newport Avenue is Retail Commercial (C-1) and therefore it would be appropriate to keep the project within the same classification. On March 26, 1984, the Tustin Planning Commission recommended approval of this zone change by the adoption of Resolution No. 2151. DATED EXHIBIT A 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 ORDINANCE NO. 910 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE RE-ZONING OF THE PROPERTY LOCATED AT 17361 MCFADDEN AVENUE FROM MULTIPLE-FAMILY RESIDENTIAL (R-3) DISTRICT TO RETAIL COMMERCIAL (C-1) DISTRICT The City Council of the City of Tustin does hereby ORDAIN as follows: I. The City Council finds and determines as follows: A. That a proper application, (Zone Change 84-1), has been filed by the City of Tustin, for a zone change from Multiple-Family Residential (R-3) District to Retail Commercial (C-1) District for the property described in Exhibit "A" attached hereto and incorporated herein by this reference as though set forth herein in full. B. That a public hearing was duly called, noticed and held on said application. C. That a zone change should be granted for the following reasons: 1. The Retail Commercial District is in conformance with the commercial land use designation of Tustin Area General Plan. 2. The Retail Commercial District designation will bring this parcel into conformance with the uses authorized under Use Permit 84-1. D. Development of subject property shall be in accordance with the policies adopted by the City Council; Uniform Building Codes as administered by the Building Official; Fire Code as administered by the Orange County Fire Marshal; and street improvement requirements as administered by the City Engineer. E. Final development plans shall require the review and approval of the Community Development Director. F. The City Council hereby approves Zone Change 84-1 for the above described property (Exhibit "A") from Multiple-Family Residential (R-3) District to Retail Commercial (C-1) District.
