It is the practice, however, in many cities, as well as Tustin, to allow the State Division of Industrial Safety to accept the responsibility for the inspection of elevators pursuant to California Administrative Code, Title 24, Section 3001. The Elevator Department of the State Division of Industrial Safety confirms that it is responsible for new elevator inspection, condemnation of unsafe elevators, and the issuance of relevant permits. Accordingly., it would appear that the Tustin' City Cod~ should be amended, to provide that inspection, approval and permit issuance is within the jurisdiction of the Division of Industrial Safety. Included with this report is a draft ordinance for City Council consideration which would, if adopted, provide for inspection, approval and permit issuance by the State. Recommndatton Direct staff to advertise a public hearing for consideration of draft ordinance No. 909.
