Applicant: Comet Neon Signs on behalf of Marie Callendar's Restaurant

Request: To receive an exception to Sign Ordinance No. 684

Section 9470 of the T~stin City Code authorizes
approval of signs not within the purview of the
Sign Ordinance. Such an exception may be granted subject to any one of
following criteria:
(1) subject property is developed with structural'setback more than two
times the minimum front setback require~ent of the district;
(2) subject property frontage is at least 75% of the minimum frontage
requirements for like signing;
(3) proposed signing does not exceed more than one in number, nor more
'than 15% in area of the aggregate size of signs authorized by the
criteria of the district;
(4) the proposed signing would be in substantial conformance with the
purposes and intent of this Chapter and would not constitute a
health or safety violation as described in Part 4 of this Chapter.

The subject site meets three of the fpur criteria.
Analysis
The signing permitted by the Sign Ordinance for a restaurant is as follows:
(1) one monument sign, thirty-two (32) square feet maximum;
(2) one wall sign, sixty-four {64) square feet maximum for each street
frontage: Subject site has two frontages;
(3) one wall sign facing each of the side and rear parking lots,
twenty-five (25) square feet per sign.
The aggregate square footage available to the applicant is 210 square feet.
The proposal, as submitted, consists of two wall signs facing First Street that
equal a combined total of 45.57 square feet. The instaqlation of a second sign
is the reason for the sign code exception. The aggregate, sign area requested
for the entire project is less than I00 square feet, or less than half of what

would otherwise be permitted. Further, the applicant has indicated that his
client has no intention of installing any signs on the northern {rear) or
eastern (Myrtle Avenue) elevations.
Reco~ndation
It is recommended that the sign code exception requested be approved by Minute
Order. Approval is recommended based on the fact that the applicant is
requesting less sign area than would otherwise be allowed; that the total number
of signs is less than would otherwise be allowed; that no more than two {2)
front wall signs will be permitted; and the proposed signing is in conformance
with the/~purpose and intent of the Sign Ordinance.
