Council Chambers, 300 Centennial Way, Tusttn, California. The Pledge of

Request: Convert an existing grocery store into a liquor mart
Alan Warren presented staff's report stating the application:had been
withdrawn and submitted into record a letter from the applicant requesting
acceptance of the withdrawal. Mr. Warren stated that many letters and
telelphone calls had been received from groups and individuals opposed to
the project. He stated that as many of those in opposition had been
contacted and informed the application had been withdrawn, thus their
absence from the meeting this evening.
It was moved by Ainslie, seconded by Well, to accept the withdrawal of the
application and receive and file staff's report. Motion carried, 4-0.

Jeff Davis presented staff's report and recommendations. Chairman Sharp
asked why'a limit was placed on the age. Mr. Dav~s replied it was to
eliminate the possibility of parking problems caused by students old enough
to drive.

Chairman Sharp opened the public hearing at 7:38 p.m. Seeing no one
wishing to speak, Chairman Sharp closed the public hearing at 7:39 p.m.
Commissioner Well recognized the applicant and asked how many teachers were
ultimately projected for the school, how many would be present at one time
and 'how many classes would be conducted. Ms. Cripps replied there would
be 8-10 teachers, 4-5 present at any one time and that classes were
one-hour long, staggered throughout the day.
Commission White asked that the minutes reflect the Commission's
willingness to raise the age limit if the applicant wishes at a later date
to make such a request.
It was moved by Ainslie, seconded by White, approval of Use Permit 84-7 by
the adoption of Resolution No. Z147 with the added condition that the hours
of operation be limited to g:O0 a.m. to 6:30 p.m. dnles% Otherwise approved
by the Director of Community Development. Motion carried, 4-0, Puckett
absent.
3. AMENDMENT NO. 84-1 TO THE ZONING ORDINANCE

Wetl commended Mr. Warren on a good report. It was moved by'Well, seconded
by Ainslie, to approve the planting plan, by Minute Order, with the'
retention of three (3) trees as indicated on the grading plan and the
inclUsion, of staff'~recommendations~as:cbntained~ih the report dated March
r~2, 1984. Motion carried, 4-0, Puckett absent.
2. New Business
a. Extended Temporary Use Permit/1984 Summer Olympic Advertising
Jeff Davis presented staff's report and recommendations. In response to
Commission questions, Mr. Davis replied that the businesses wanting to
display such advertising would have to apply for a temporary use permit.
The application is subject to review to determine official sponsorship and
allow review of the type of banners to be displayed.
It was moved Atnslte, seconded by White, by Minute Order, to authorize the
Director of Community Development to issue temporary use permits for
official Olympic sponsors to display banners for the duration of the
Games. Commissioner Well asked when the authorization would take effect.
Mr. Davis replied it Would be effective Tuesday, March 13, 1984 and would
terminate with the closing of the Games. Motion carried, 4-0, Puckett
absent.

Alan Warren presented staff's report and recommendations. Commissioner
Well asked if the buildtng was speculative or had tenants already bqen
determined. Mr. Warren replied the building was, for the most part,
speculative.
It was moved by Weil, seconded by A{nslie, to receive and file staff's
report. Motion carried, 4-0, Puckett absent.
STAP CONCERNS

Alan Warren presented staff's report. By unanimous informal consent, the
Commission received and ftled staff's report.

Commission received and filed staff's report.
COI~ISSION CONCERNS
Commissioner Weil expressed concern regarding the brevity of the Planning
Commission Action Agenda. She suggested perhaps the Agenda could be
expanded to provide more information on controversial items, thereby
providing better communication with the Council.
Commissioner Well relayed information on the Planning Commissioners
Institute in San Diego, which she and Commissioner Puckett attended.
Commissioner Ainslie commended the Tustin Community Hospital for the
excellent care he received recently.

SUBJECT: Amendment No. 84-1 to the Zoning Ordinance - Children's Day Care
Homes
Background
On September 29, 1983, the Govenor signed into law, Senate Bi. ll No. 163,
concerning the regulation of children's day care homes. The new legislation
somewhat preempts local zoning authority in that small family day care homes
(for six or fewer children) are to be allowed by right in single-family
residential zones. Secondly, the law provides that cities must grant permits
for large family day care homes (seven to twelve children) when certain
conditions are met. The new law does give local jurisdictions some latitude by
granting authority for ci~ies to require use permits for large family homes.
Discussion
As enacted, the legislation requires that cities must do one
in regards to large family day care homes:
of the following
1. Classify these homes as a permitted use.
2. Grant a nondiscretionary permit that complies with local ordinance
prescribing reasonable standards and restrictions concerning spacing,
concentration, traffic control and noise control...and, which complies with
regulations of the State Fire Marshal..
3. Require any large family day care homes to apply for a permit to use a lot
zoned for single-family dwellings. There are several sections to this
process.
a) The use permit shall be granted if the same standards noted in #2 above
are ~t.
b) Not less than ten (10) days prior to the date a decision is made (by a
Zoning Administrator or Planning Commission) written notice shall be
sent to all property owners within a lO0-ft, radius of the property.
c) No hearing on the application for permit issued...shall be held before
a decision is made unless a hearing is requested by the applicant or
other effected persons.

That the provisions of this amendment shall not apply to small or large
family day care homes already licensed by the County and in operation
prior to January 1, 1984. However, said homes may not increase the
number of children cared for without complying with the standards listed
herein.

Staff recommends the Commission adopt and forward to the City Council Resolution
No. 2140 amending Tustin City Code Section 9223 to include "large family day
care homes" as permitted uses subject to specific development standards.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, CALIFORNIA, RECOMMENDING AMENDMENT OF
SECTION 9223a OF THE TUSTIN CITY CODE BY REQUIRING
A SPECIAL PERMIT FOR LARGE FAMILY DAY CARE HOMES IN
THE SINGLE FAMILY RESIDENTIAL {R-i) DISTRICT AND
SECTION 9297 OF THE CITY CODE TO INCLUDE THE DEFINITION
OF LARGE FAMILY DAY CARE HOMES
The Planning Commission of the City of Tustin does hereby resolve as
follows:
I. The Planning Commission finds and determines as follows:
A. That there is a growing need for properly licensed
care facilities within the Community.
B. That as an alternative by which to provide such day
care facilities, the State of California has authorized
local jurisdictions to permit day care facilities for a
maximum of twelve (12) children in Single-Family
Residential zones. Such homes shall be approved upon
findings that such facilities comply with all local
ordinances presribing reasonable standards, restrictions
and requirements concerning spacing and concentration,
traffic control, parking and noise control relating to
such facilities.
C. That to ensure that the integrity of the Single-
Family Residential zone is maintained, and to determine
if each application for a large family day care home
(defined as a home for seven to twelve children) is in
compliance with all applicable standards for spacing and
concentration, traffic contro), parking and noise
control, Section 9223a of the Tustin City Code shall be
amended to include as a permitted use subject to a
permit issued by the Community Development Department:
Large Family Day Care Homes for up to a maximum of
twelve (12) children.
II.
The Planning Commission hereby recommends to the City
Council of the City of Tustin, that Section 9223a of the
Tustin City Code be amended to read as follows:
Section 9223a
6. Large Family Day Care Homes, caring for seven to
twelve children subject to the following standards:
a. Such day care homes shall be operated in a manner
not exceeding the noise levels in the Tustin Noise
Ordinance.

III.
b. All property owners within 100 feet of a proposed
large family day care home shall be notified of
the intent to establish such a home.
c. A permit shall not be granted for a day care home
that would be established within 100 feet of any
existing licensed home or if any written protest
against permit issuance is received from an
abutting property owner to the proposed large
family day care home.
d. All homeowner vehicles shall be parked on private
property during hours of operation of the day care
home.
e..Any employed assistants shall park on the private
property of the large family day care home.
f. Any day care home must comply with all regulations
adopted and enforced by the State Fire Marshal.
g. The rear yard of the home must be enclosed by a
minimum six foot (6') fence.
h. That the provisions of this amendment shall not
apply to small or large family day care homes
licensed by the County and in operation prior to
January i, 1984. However, said homes may not
increase the number of children cared for without'
complying with the standards listed herein.
The Planning Commission further recommends to the City
Council that Section 9297 be amended to include the
following:
Section 9297 Definitions
"Large Family Day Care Homes" means a family dwelling
unit, non-institutional in character, properly licensed
by the County of Orange, which provides day care only,
for a maximum of twelve (12) children ages 16 years or
younger, including the licensee's own children.

Section 9233c of the Zoning Code states that cleaning and dyeing establishments
are a permitted use subject to a use permit.
Mr. Lee is requesting authorization to operate a dry cleaning plant with a
retail area. The main areas of concern are:
The'plant activities regarding noxious fumes and unpleasant odors. A permit
must be obtained from the Air Quality Management District which will help to
mitigate these concerns;
2. Any additional roof top equipment shall be screened from view and be
constructed of materials matching those existing in the center; 'and

The owner should recognize that the tenant space may, by its location within
the complex, not afford adequate drive-by customer visibility and that the
sign code does not provide for additional signing identity beyond that
provided by the center's master sign plan.

and Fire Codes for such a use.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN, CALIFORNIA, APPROVING USE PERMIT NO. 84-9 TO
OPERATE A RETAIL DRY CLEANING ESTABLISHMENT AT
17440 E. SEVENTEENTH STREET, SUITE D, ENDERLE CENTER
The Planning Commission of the City of Tustin does hereby resolve as
follows:
I.
The Planning Commission finds and determines as follows:
A. That a proper application (Use Permit 84-9) was filed by
Su Chert Lee, requesting authorization to operate a retail dry
cleaning establishment at 17440 E. Seventeenth Street, Suite D,
in Enderle Center.
B. That a public hearing was duly called, noticed, and held on said
application.
That establishment, maintenance, and operation of the use
applied for will not, under the circumstances of this case, be
detrimental to the health safety, morals, comfort or general
welfare of the persons residing or working in the neighborhood
of such proposed use as evidenced by the following findings:
1. The use is in conformance with the commercial zoning
regulations of the Tustin City Code.
2. The parking accommodations for the shopping center are more
than adequate for the existing uses and this proposed use.
That establishment, maintenance, and operation of the use
applied for will not be injurious or detrimental to the property
and improvements in the neighborhood of the subject property,
nor to the general welfare of the City of Tustin and should be
granted.
Proposed development shall be in accordance with the development
policies adopted by the City Council, Uniform Building Codes as
administered by the Building Official, Fire Code as administered
by the Orange County Fire Marshal and street improvement
requirements as administered by the City Engineer.
F. This project is categorically exempt from the requirements of
the California Environmental Quality Act.
G. Final development plans shall require the review and approval of
the Community Development Department.

following conditions:

'On February 27, 1984, the Planning Commission approved Use Permit No. 84-1 which
authorized the use of a multiple-family district parcel as a parking lot for a
retail commercial shopping center. The land use General Plan designation for
the parcel is Commercial and a condition of the use permit approval was that the
owner would agree to bring the zoning district into conformance with the General
Plan. ~
The property adjacent to this small parcel on which the building will be located
is in the C-1 District and it therefore would be appropriate to keep the project
within the same classification.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, RECOMMENDING RE-
ZONING OF THE PROPERTY AT 17361 MCFADDEN AVENUE
TO THE RETAIL COMMERCIAL DISTRICT (C-1)
The Planning Commission of the City of Tustin does hereby resolve as
follows:
I.
The Planning Commission finds and determines as follows:
A. That a proper application, (Zone Change 84-1) has been filed
on behalf of Mary Anne Barker and the Tustin Planning
Commission to recommend a zone change for the property at
17361 McFadden Avenue (Assessor's Parcel #402-331-15) to the
Retail Commercial District (C-1).
B. That a public hearing was duly called, noticed and held on
said application.
C. That a zone change should be granted for the following
reason:
1. The proposed zone designation is in conformance with the
Land Use Element of the Tustin Area General Plan.
D. Development of subject property shall be in accordance with
the policies adopted by the City Council; Uniform Building
Codes as administered by the Building Official; Fire Code as
administered by the Orange County Fire Marshal; and street
improvement requirements as administered by the City
Engineer.
E. Final development plans shall require the review and approval
of the Director of Community Development Department.
F. A Negative Declaration has been filed in conformance with the
requirements of the California Environmental Quality Act.
II.
The Planning Commission hereby recommends to the City Council
approval of Zone Change No. 84-1 to designate the Retail
Commercial District (C~1) for the property at 17361 McFadden
Avenue.

SUBJECT: Request for Zone Change
Enclosed is a request for-a zone change for the property at 14462 Red Hill
Avenue. The property is currently zoned R-4 and the General Plan calls for it
to be Professional. The owner is now requesting that the Planning Commission
initiate the change of zone from R-4 (Suburban multiple-family) to Planned
Community Professional'(PCJPR).
Section 9295c of the City Code states that the Planning Commission shall pass a
resolution of intention.
Enclosed is a copy of Mr. Matt Nisson's request and a resolution for the
Planning Commission's consideration initiating a joint application.
