HomeMy WebLinkAboutNB 2 INSPEC MBL HM PKS 03-05-84DATE: March 5, 1984 ~ BUSINESS NU. 2 3-5-84 Inter-Corn FROH: S USJ ECT: Honorable Mayor & Members of the City Council Community Development Department City Inspection of Mobile Home Parks The Community Development Department requests the City Council adopt the attached resolution cancelling the City's assumed responsibility for enforcement of Mobile Home Park Regulations required in California Health and Safety Code, Section 18300 and California Administrative Code Title 25. The City assumed such responsibility.in 1964. The City is required to conduct annual inspections and enforce State regulations. Also, the local enforcement agency is responsible to demonstrate actual inspection capability in making a mobile home installation inspection to the satisfaction of the State Department. This has become more of a problem with seven mobile home parks, 740 spaces within the City, and a small inspection staff. Furthermore, the fees do not cover the 'cost of inspection services. The State Department of Housing and Community Development has specialists in the field who perform very well throughout the state and enforcement would likely be more than adequately performed. There is no reason to expect City inspectors will better assure conformance to required standards. Cancellation would not affect business license fees or our responsibility for building permits where applicable. Alan G. Warren Senior Planner AGW:jh ! 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 RESOLUTION NO. 84-26 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CANCELLING ITS ASSUMPTION OF RESPONSIBILITY FOR THE ENFORCEMENT OF SECTION 18300 ET. SEQ. OF THE HEALTH AND SAFETY CODE RELATING TO MOBILEHOME PARKS AND RESCINDING RESOLUTION NO. 686 WHEREAS the City of Tustin is currently responsible for the enforcement of Section 18300 et. seq. of the Health and Safety Code; and WHEREAS because of financial and staff considerations the City is desirous of relinquishing its responsibility for said enforcement to the State Department of Housing and Community Development; and WHEREAS Health and Safety Code Section 18300 states that "any city...upon written notice from the governing body to the Department of Housing and Community Development, may cancel its assumption of responsibility for the enforcement of this part (Section 18300 et. seq.). The Department, upon receipt of such notice, shall assume such responsibility within 30 days". NOW, THEREFORE, the City Council of the City of Tustin does hereby resolve as follows: SECTION 1. The City of Tusttn does hereby relinquish its responsibility for enforcement of Health and Safety Code Section 18300 et. seq. for relating to Mobilehome Parks. SECTION 2. The City Clerk is directed to forward a copy of this resolution to the Department of Housing and Community Development, Sacramento.
