RECOMMENDATION:
City Council to approve subject Resolution designating management'and
confidential employees.
DISCUSSION:
The attached is simply a "housekeeping" Resolution designating management and
'confidential employees. Section 3507.5 of the Meyers-Milias-Brown Act specifies
that a public agency may designate management and confidential employees and
restrict such employees from representing any employee organization which
represents other employees of the public agency on matters wtthin the scope of
representation.
The attached Resolution adds the positions of Recreation Superintendent, Water
Service Manager, and Water Services Analyst to management and the position of
Secretary/Administrative Services to confidential. The Recreation
Superintendent position has been considered a management position since
inception and we require a Resolution to officially so state. Second, the Water
Services Manager and Analyst need to be designated, management officers regarding
employer-employee relations even though these two positions are compensated
through employment agreements separate from other employees. Third, it has
'become evident that the Secretary in the Administrative Services Department
should be a confidential employee. This Resolution accomplishes that and is
consistent with statutes which define confidential employees as any individual
who is privy to information and decisions of management effecting
employer-employee relations.
Both the City Manager and City Attorney have reviewed the Resolution and
recommend its adoption by Council.

A RESOLUTION OF ll~E CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, RELATING TO THE DESIGNATION
OF MANAGEMENT AND CONFIDENTIAL EMPLOYEES
WHEREAS, Section 3507.5 of the Meyers-Milias-Brown Act (Government
Code) specifies ~hat a public agency may designate management and confiden-
tial employees and restrict such employees from representing any employee
organization which represents other employees of the public agency on mat-
ters within the scope of representation.
NOW, THEREFORE, the City Council of the City of Tustin,
California, does hereby resolve as follows:
Section 1. Administrative Officers.
Those employees holding the positions listed below are hereby
designated as management (Administrative Officers) and are hereby restricted
from representing any employee organization which represents other employees
of the City on matters within the scope of representation.
City Manager
Chief Deputy City Clerk
Director of Co,~unity and Administrative Services
Director of Con~nunity Development
Director of Finance
Director of Public Works/City Engineer
Police Chief
Section 2. Mid-Management Officers.
Those employees holding the positions listed below are hereby
designated as management (Mid-Management Officers) and-are hereby restricted
from representing any employee organization which represents other employees
of the City on matters within the scope of representation:
Administrative Assistant
Assistant City Engineer
Finance Coordinator
Maintenance Foreman
Maintenance Superintendent
Police Captain
Police Lieutenant
Police Sergeant
Records Supervisor
Recreation Superintendent
Recreation Supervisor
Senior Planner

Section 3. Mid-Management Officers
Those employees holding the positions listed below are hereby
designated as management (mid-management officers) for the purpose of
employer-employee relations; however terms of their employment are covered
by employment agreements and not salary resolutions applicable to other
management employees. They are hereby restricted from representing any
employee organization which represents other employees of the City on
matters within the scope of representation:
Water Services Manager
Water Services Analyst
Section 4. Confidential Employees.
Those employees holding the following positions are hereby desig-
nated as Confidential Employees, and are hereby restricted from representing
any employee organization which represents other employees of the City on
matters within the scope of representation:
Administrative Secretary
Office Coordinator
Personnel Analyst
Secretary/Administrative Services Department
