BACKGROUND: On November 23rd, Mr. McNutt of Community Cablevision Company (the cable company serving the Laurelwood and Peppertree areas of Tustin), met with staff to discuss a proposed rate increase for cable services. Subsequently, on December 8th, a letter delineating the proposed rates was received. (Copy of current/proposed rates attached). According to the existing franchise, the cable company must submit a request of rate changes to the City Council via the public hearing process. Community Cablevision Company has complied with the terms of the franchise and has proposed rates consistent with those of other cable companies in the area. Community Cablevision Company last requested and received approval for a rate increase in April, 1981. Since that time they have expanded their system to include five (5) premium pay television channels and nine (g)satellite received basic channels. During this period, they also increased their customer service staff, expanded the telephone system to provide more expedient service and upgraded the overall level of system-wide maintenance. In addition to system enhancement cost, general inflationary increases have been experienced in all areas of operations. Mr. McNutt indicated they would like to implement the new rates in February; they would also like to give the subscribers a thirty (30) day notice of the new rates. In order for the company to move expeditiously and for the convenience of the Council, if the Council should approve the proposed rate increases, the appropriate resolution has been drafted and submitted for adoption. BACKGROUND: In accord with the franchise agreement, Community Cablevision Company submitted an official request for public hearing to increase their rates for various services. The proposed rates were reviewed by staff and foundltO, be in congruence with rates charged by other cable' companies in the area. Community Cablevision is proposing to implement the new rates, if adopted, in February of 1984. WHEREAS, Community Cableviston Company applied to the City Administrator for rate increases pursuant to Tusttn City Code Section 7421b; WHEREAS, the City Administrator conducted a preliminary investigation into the matter during Oecember, lg83; WHEREAS, the City Admtntstrator'prepared a report for the public hearing containing his findings and his recommendations concerning the application of Community Cablevtsion Company; and WHEREAS, the City Council of the City of Tusttn, California, determines that good cause exists to adopt the opinion and recommendation of the City Administrator. NOW, THEREFORE, the City Council of the City of Tustin, California, resolves to adopt the recommendations of the City Administrator pertaining to the application of Commntty Cableviston Company, as follows: The City Council approves the follo~ng rates to be effective for said service comnencing on January 3, 1984: 1.
