S 1-16-84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AFFIRMING PLANNING COMMISSION APPROVAL OF USE PERMIT 83-25 AUTHORIZING A NINE-FOOT BLOCK WALL AT 1331 GARLAND AVENUE, WITH AMENDMENTS 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 The City Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: A. That a proper application, (Use Permit No. 83-25) was filed by O'Dell and Associates on behalf of Mr. and Mrs. William Heller, requesting authorization to retain a nine-foot block wall along the easterly property line of the single-family dwelling at 1331 Garland Avenue. B. That a public hearing was duly called, noticed and held on said application on December 12, 1983. C. That the project was determined to be categorically exen~t from the requirements of the California Environmental Quality Act. D. That the Planning Commission of the City of Tustin, by Resolution No. 2133, did approve said use permit application authorizing the nine-foot block wall. E. That the City Council, at their meeting of December 19, 1983, by a vote of five ayes to zero noes, appealed the decision of the Planning Commission pursuant to City Code Section 9294b. F. That a public hearing to consider the appeal was duly called, noticed and held on January 3, 1984. G. That the City Council determined that the findings and conclusions of the Planning Commission concerning the height of the wall were correct; however, the Council overturned Condition II(A) of Planning Commission Resolution No. 2133 concerning submission of structural calculations, plans and other documents required by the Building Department and Condition II(B) concerning installation of a curb cut and drive apron. II. The City Council of the City of Tustin does hereby affirm the findings of the Planning Commission as contained in Resolution No. 2133, and approves a nine-foot block wall along the easterly property line of the single-family dwelling at 1331 Garland, subject to the following conditions: 26 27 28 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 Resolution No. 84-8 Page 2 A. That all structural calculations, plans and other documents required by the Building Department for plan check and permit issuance must be submitted within thirty (30) days from the date of original Planning Commission approval. Documents must be submitted by January 12, 1984. B. That an additional curb cut and drive apron shall not be installed along Woodlawn Avenue and vehicular access through the gate in the wall is prohibited.
