At that time the center did not include the parcel, of land where Marshall's Department sto~e is presently located. The owner, Mr. Zappas,.has since purchased:the Marshall's parcel and made various improvements to the building. The owner is now requesting authorization to add a new 4,000 square foot retail building on the corner of Sixth Street and E1Camino Real next to Marshall's. RDA 84-1 A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE DESIGN OF A COMMERCIAL BUILDING TO BE CONSTRUCTED AT SIXTH STREET AND EL CAMINO REAL AS APPROVED BY THE PLANNING COMMISSION PURSUANT TO USE PERMIT 83-22 The Community Redevelopment Agency of the City of Tustin, California does hereby approve the use and design of the proposed building to be constructed at the southeasterly corner of Sixth Street and E1Camino Real, based on the following findings: A. The design and proposed use of the project, subject to conditions of approval, are compatible with the goals and obj&ctives of the Town Center Redevelopment Project Plan. B. The architectural and physical design of this Phase II project are compatible and consistent with other architectural styles of buildings within the immediate area, including Phase I. C. That based on the findings, determinations and conditions contained in the Planning Commission Resolution No. 2123, the project should be a positive addition to the community. .PASSED AND ADOPTED at a regular meeting of the Community Redevelopment Agency held on the 16th day of January, 1984, subject to the conditions listed in Planning Commission Resolution No. 2123. Wynn Secretary 28 1 2 3 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 2,~ 25 26 27 28 RESOLUTION NO. 2123 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, GRANTING A USE PERMIT TO AUTHORIZE DEVELOPMENT OF AN ADDITIONAL 4,000 SQUARE FEET OF RETAIL COMMERCIAL BUILDING AT THE .SOUI"dWESTERLY CORNER OF SIXTH STREET AND EL CAMINO REAL IN THE EL CAMINO PLAZA SHOPPING CENTER The Planning Commission of the City of Tusttn does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That a proper application, (Use Permit 83-22) was filed by William Bender on behalf of William Zappas requesting authorization to construct a 4,000 square foot retail commercial building in the E1Camino Plaza Shopping Center at the southwesterly corner of Sixth Street and E1Camino Real. B. That the project is categorically exempt from the requirements of the California Environmental Quality Act, Class I(e). C. That a public hearing was duly called, noticed and held on said application. D. That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use as evidenced by the following findings: 1. the use is in conformance with the Tustin Area General Plan and City Code Zoning provisions. 2. the shopping center is an existing development. E. That that establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin and should be granted. F. Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered 'by the Orange County Fire Marshal and street improvement requirements as administered by the City Engineer. The Planning Commission hereby grants a use permit, as applied for, to authorize the construction of a 4,000 square foot building addition to E1Camino Plaza, subject to the following conditions: Any construction within the public right-of-way shall be so indicated with the appropriate City standards on the final site or grading plan. Marbeltta street lights, with underground conduit, shall be required across the Sixth Street frontage per the master plan layout available at the City Engineer's office. C. A grading plan shall be required for all proposed work related to the new building and the new parking area. Payment of Orange County Sanitation District No. 7 fees in the amount of $50.00/1,000 square feet of building area prior to the issuance of a building permit. E. Payment of East Orange County Water District fees prior to the issuance of a building permit. Signs will require approval before permit issuance and shall match the master sign plan for E1Camino Plaza.
