The City Council upheld the findings of the Plan- ning Commission on subject item. RECOI~NOATIO#: Adopt Resolution No. 84-4. 1 2 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 RESOLUTION NO. 84-4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA., AFFIRMING THE FINDINGS OF THE PLANNING COMMISSION CONCERNING AMENDMENT NO. 1 TO USE PERMIT NO. 80-3 The City Council 'of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: A. That a proper application, (Amendment No. i to Use Permit No. 80-3) was filed by the Burnett-Ehline Company requesting authorization to develop a 17,740 square foot building addition in the commercial/office center bounded by Irvine Boulevard, Holt Avenue and Newport Avenue. II. B. That a public hearing was duly called, noticed and held on said application on November 28, 1983. C. That the Planning Commission of the City of Tustin, by Resolution No. 2124, did approve said amendment with authorization to develop a commercial/office building. D. That the City Council, at their meeting of December 5, 1983, appealed the decision of the Planning Commission pursuant to City Code Section 9294b. E. That the City Council determined that the findings of the Planning Commission were appropriate to mitigate ~ negative environmental impacts. The City Council of the City of Tustin does hereby affirm the findings of the Planning Commission as contained in Resolution No. 2124, subject to the following: A. That the developer consider negotiations with the City to purchase land from the City for right-of-way access to Newport Avenue.
