A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA,
AFFIRMING THE FINDINGS OF THE PLANNING COMMISSION CONCERNING USE PER-
MIT NO. 83-24
BACKGROUND:
Use Permit No. 83-24 was appealed by the applicant and City Council,
and a public hearing was conducted at the December 19, 1983, City
Council meeting. Resolution No. 84-5 incorporates the findings of
the City Council.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, AFFIRMING THE FINDINGS OF THE
PLANNING COMMISSION CONCERNING USE PERMIT NO. 83-24

I. The City Council finds and determines as follows:
A. That a proper application, (Use Permit No. 83-24)
was filed by Systems Engineering, Inc. on behalf of
Walter J. Fredriksen, requesting authorization to
develop a five-unit apartment building on a 50'-wide,
R-3 District lot, 81' from the R-1 District at 545 South
"B" Street.
B. That a public hearing was duly called, noticed and
held on said application on November 28, 1983.
C. That the Planning Commission of the City of Tustin,
by Resolution No. 2128, did approve said use permit
application with authorization to develop four
apartment units.
D. That Walter J. Fredriksen did appeal the decision and
the City Council appealed the Planning Commissi'on
decision at its December 5, 1983 meeting pursuant to
City Code Section 9294b.
E. That the City council determined that the applicant
should be allowed to develop the property to the maximum
number of units authorized by law.

The City Council of the City of Tustin does hereby
affirm the findings of the Planning Commission as
contained in Resolution No. 2128, subject to the
following:
A. That the project is approved for five (5) units as
requested.
B. That the building footprint shall be oriented
adjacent to the southerly property line (reversed
from the original submittal).

C. That a six foot (6') high fence shall be provided
along the interior property line. That the lower
three feet {3') of the fence adjacent to the driveway
shall be constructed of decorative concrete block.
PASSED AND ADOPTED at a regular meeting of the Tustin City
Council held on the 3rd day of January, 1984.
