ADJ. 84-1 01-03-84 AGENDA DATE: DECEMBER 20, 1983 ;ONSENT CALENDAR NO. 11 1-3-84 Inter-Corn FROM: $ UBJ ECT: WILLIAM HUSTON, CITY MANAGER BOB LEDENDECKER, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER LOT LINE ADJUSTMENT NO. 84-1 (1781 RIVER FORD ROAD) RECOMMENDATION: Inat the Tustln City Council, at their meeting of January 3, 1983, adopt the attached resolution approving Lot Line Adjustment No. 84-1. BACKGROUND: Mr. and Mrs. James Sandin and the Atchison, Topeka, and Santa Fe Railway Company are requesting a lot line adjustment between their parcels of land to transfer rail road land to the Sandtns. Ultimately, six additional adjustments will be required between Sandin and the owners of lots 1,2,3,4,5, and 7. These adjustments will eliminate the long term condition of an unattended rail road right of way, which in the past has been a big source of complaints from the residents of the neighborhood. DISCUSSION: T~is lOt line adjustment process is provided for in section 66412 (d) of the subdivision map act wherein the act makes provisions for the local agency to approve lot line adjustments where the land taken from one parcel is added to an adjacent parcel and where a greater number of parcels than originally existed is not thereby created. The attached documents, consisting of a resolution and three sheets of an application for lot line adjustment, will provide this adjustment once the resolution has been adopted by Council, the application approved by staff, and when all the documents have been recorded by the County Recorder's office. This process and these documents have been reviewed and approved by ihe City Attorney's office. This application has been reviewed by both the Community Development Department and the Engineering Division and all proposed adjustments have been found to be in compliance with all zoning and setback requirements of the City and the provisions of the California Subdivision Map. SIEGEL .'// Licen~ed Land Surveyor No. 4125 1 2 3 4 5 6 7 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 RESOLUTION NO. 84-6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO. 84-1 WHEREAS, Section 66412 (d) of the Subdivision Map Act makes provisions for the local agency to approve lot line adjustments where the land taken from one parcel is added to an adjacent parcel and where a greater number of parcels than originally existed is not thereby created; and WHEREAS, the City Council of the City of Tustin has reviewed Lot Line Adjustment No. 84-1 and has made a finding that the real property described in Exhibit A and shown on Exhibit B complies with the provisions of the California Subdivision Map Act and applicable City of Tustin ordinances and regulations including the requirements for building sites; and WHEREAS, the City Council of the City of Tustin has ~ade the following findings: '2. That the proposal is eligible for processing as a lot line adjustment pursuant to Section 66412 of the Subdivision Act; That the rgquirements of the California Environmental Quality Act have been met; 3. That the proposal is consistent with the. General Plan; and 4. That the resultant parcels will meet the requirements of the Zoning Code; NOW, THEREFORE, BE IT RESOLVED that the proposed Lot Line Adjustment No. 84-1 as shown on Exhibits A and B is hereby approved and that the parcels be considered building sites upon recordation of this document.
