HomeMy WebLinkAboutCC MINUTES 1956 09 27252 MINUTES OF THE ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF TUSTIN HELD ON SEPTEMBER 27th, 1955. PRESENT: Kidd, Tadlock, Humeston, Bacon and Byrd. ABSENT: A. O. Park, City Clerk; C. Arthur Nisson, Jr. City Att'y was present and acted as Clerk protem at the request of the Mayor. The Minutes of the preceding regular meeting of September 24, 1956, were not read, said reading being held over until the next regularly scheduled meeting. Mayor Kidd announced that it was the time and place for the hearing of the appeal of Mrs. Wolzcek and Others from the action of the Planning Commission of the City of Tustin granting a Variance to W. K. Hillyard concerning property immediately East of the Mullen Lumber Company on East HEARING First Street. At the request of the Mayor, the City Attorney ON THE read the minutes of the Planning Commission of September 17, GRANTING 1956 concerning the filing of the appeal, and Notice of OF Appeal was read as prepared and presented by Robert Frazer, VARIANCE attorney representing the appellants. A Resolution of the TO W.K. Planning Commission granting the variance was read. There HILLYARD after Mayor Kidd advised Mr. Frazer on behalf of the appellants CONCERNING that it was the time and place for him to present his case PROPERTY on behalf of the appellants. Mr. Frazer spoke on behalf of OF MULLIN the appellants and presented six separate petitions, each LUMBER being alike in form, which were claimed to bear the signatures COMPANY. of 252 residents, in which were included 169 registered voters and 113 property owners. In addition to Mr. Frazer, Mrs. Wolzcek, Mr. Gilbreath and Mrs. Cleary and several others spoke on behalf of the appellants. At the close of the appellants' presentation, Mr. Jacobson spoke on behalf of the action of the Planning Commission in granting the variance. He was followed by Mr. W. K. Hillyard, the respondent and Wayne Mullen and Lynn Snyder, all on behalf of the respondent. After the presentation of the case for the action ACTION OF of the Planning Commission by the respondent, Mr. Frazer was PLANNING heard in rebuttal and also Mrs. Wolzcek. Whereupon Mayor COMMISSION Kidd hearing no further comments from the floor closed the REVERSED. public hearing and the City Council discussed the pros and cons of the appeal. Councilman Humeaton moved that the appeal be granted and that the action of the Planning Commission granting the variance be reversed, and that the City Attorney be instructed to prepare a resolition to this effect. Council- man Tadlock seconded the motion. Uoon roll call vote the motion was carried on the affirmative vote of Tadlock, MOTION Humeston and Byrd. Councilman Tadlock moved, Humeston second- MADE TO ed, the meeting be adjourned to 7:30 O'clock P. M. in the PREPARE Council Chambers on October 1, 1956. Motion duly carried.
