MINUTES OF THE REGULAR MEETING OF THE
TUSTIN CITY COUNCIL
MONDAY SEPT 11, 1956
COUNCILMEN PRESENT: Lee A. Byrd, Frank E. Bacon, Jr.
Vincent L. Humeston, W. L. Tadlock
and Jerome C. Kidd.
COUNCILMEN ABSENT: None
CITY ATTORNEY: C. Arthur Nisson, present.
Meeting was called to order at 7:30 P. M.
by Mayor Jerome C. Kidd.
Motion by Councilman Bacon, seconded by Councilman Byrd and
duly carried, that Minutes of last meeting be approved as
mailed out.
The following bids for the improvement of So. "C" Street and
Sixth streets were opened.
Griffith Co. Bidder's Bond $1300.00 Bid $12,001.00
BIDS Sully Miller Co. Check 1350.00 Bid 11,593.90
R. J. Noble Co. Bidder's Bond 10% Bid 12,292.31
Upon Motion by Councilman Byrd, seconded by Councilman Tadlock
that City Engineer McBride check bids and forward to state for
approval. Motion carried.
Motion by Councilman Byrd, seconded by Councilman Tadlock that
REMOVAL Engineer McBride check the bids for the removal of Pepper trees
OF on the South "C" and 6th street project, and with the approval
PEPPER of Councilman Bacon, award the contract to the lowest responsible
TREES bidder. Motion carried.
Mr. C. T. Gilbreath, of 520 "D" Street was present regarding
a private line that crosses South "C" Street and issued to
GILBREATH irrigate his orange trees. He was informed by Attorney Nisson
that the City had no responsibility to replace the line in the
process of re-paving South "C" Street.
Councilman Tadlock moved, seconded by Councilman Humeston that
City Engineer McBride be authorized to contact property owners
on South "C" Street concerning running S. A. V. I. irrigation
S.A.V.I. water along the curb on the Eastside of South "C" Street,
north of 6th Street to serve C. T. Gilbreath, and that if
necessary consent cannot be obtained, the City Engineer is to
notify C. T. Gilbreath that the city will require the removal
of his private irrigation line in South "C" Street in connection
with the improvement of South "C" Street between Main and Sixth
Street. Motion carried.
The problem of a walk along the west side of Prospect Ave.
WALK was again discussed and upon Motion by Councilman Tadlock,
PROSPECT seconded by Councilman Humeston that the matter be referred to
AVENUE Engineer McBride and to report his findings to Counctlman Byrd
and if it was found that a walk could be constructed for a
reasonable sum to either go ahead with it or report back to
the Council at next meeting. Motion carried.
HILLYARD An appeal to the granting of a variance to W. K. Hillyard was
VARIANCE filed with the City Clerk, Tuesday September 11, 1956 by
APPEAL Carol A. Wolczak and others and on Motion by Councilman
Tadlock, seconded by Councilman Byrd that a hearing on the

appeal be set for 7:30 P. M. September 27, 1956 at an adjourned
Council meeting and the City Clerk to give the required notices.
Motion carried.
REFUND Chamberlain and Roach filed a letter with the Council requesting
OF that their assessment on Personal Property for the year
TAX be reduced and that they be allowed a refund on Taxes paid. Upon
motion by Councilman Tadlock, seconded by Councilman Byrd and
carried, the matter was referred to Attorney Nisson for a ruling.
SECOND Motion by Councilman Bacon, seconded by Councilman Humeston that
READING Ordinance No. 102 have its second reading by Title only. "An
ORD. Ordinance amending Ordinance No. 71 (Section 5 (a) and 5 (c) con-
#102 cerning Annexations designated as, Claus, Griset, Pankey, Gentry · .
and other areas within the City. Motion carried. All Councilmen
voting Aye.
Motion by Councilman Humeston, seconded by Councilman Byrd that
ADOPTION Ordinance No. 102 be adopted was duly carried, all Councilmen voting

Motion by CouncilmanHumeston, seconded by Councilman Tadlock
APPRO- that Resolution No. 399, "a Resolution setting a tax rate of .90
VAL OF per hundred dollars assessed valuation for the fiscal year
RES. be approved. Motion carried. All councilmen voting aye.

Motion by Councilman Tadlock, seconded by Councilman Byrd that
GREATER Councilman Humeston contact the Greater Tustin improvement
POSTAL Association regarding new petitions to extend Postal service.
AREA. Motion carried.
Motion by Councilman Tadlock, seconded by Councilman Byrd that
an ad be inserted in the Tustin News for a part time Building
Inspector. Motion carried.
Motion by Councilman Bacon, seconded by Councilman Tadlock
APPEAL that Attorney Nisson proceed with whatever steps necessary
OF PRES- to appeal the decision in the Prescott case. Motion carried.
COTT CASE.
Motion by Councilman Tadlock, seconded by Councilman Humeston
and duly carried that the following bills be paid:
