Applicant: Location: Zoning: Request: The Well f ngton Group 14351 Red Hill Avenue R-3 A Use Permit application requesting construct an office condominium. authorization to Background Variance 81-5 was heard on this property on August 3, 1981, requesting a rear and front yard setback. The Variance was approved, allowing a six (6) foot rear setback in lieu of ten (10) feet, and a seventeen (17) foot set- back in lieu of twenty (20)feet. A seventeen (17) foot dedication is required to bring the site to the current fifty (50) foot centerline right-of-way. An additional ten (10) feet of dedication or an irrevocable offer of dedication will be required for the future widening to a sixty (60) foot centerline right-of-way. The site is currently vacant land. Discussion This use permit as requested, is only for the conversion of the proposed office building for condominiums. In regard to any plans submitted or proposed with this Use Permit, all requirements and conditions of Variance 8I-5 still apply and no deviations will be permitted. EMK:jh 1-21-82 1 2 3 4 5 The Planing follows: 6 I. 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 RESOLUTION NO. 2016 A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF TUSTIN, AUTHORIZING A PROPOSED OFFICE STRUCTURE AT 14351 RED HILL AVENUE TO CONVERT TO AN OFFICE CONDOMINIUM. Agency of the City of Tustin does hereby resolve as The Planning Agency finds and determines as follows: A. That a proper application, (Use Permit No. 82-1), has been filed by the Wellington Group to allow the proposed office structure to be sold as an office condominium concept. B. That a public hearing was duly called, noticed and held on said application. C. That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1. The proposed use is in conformace with the Tustin Area General Plan. 2. The proposed use is in conformace with the Zoning Code, as amended. D. That the establishment, maintenance, and operation of the use applied for will not be injurious or detri- mental to the property and improvements in the neighbor- hood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. E. Proposed development shall be in accordance with the development policies adopted by the City Council, Uni- form Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fire Marshal and street improvement requirements as administered by the City Engineer. F. This project is categorically exempt from the re- quirements of the California Environmental Quality Act. G. The Planning Agency hereby approves Conditional Use Permit No. 82-1, to authorize the proposed office structure at 14351 Red Hill Avenue to be sold as an office condominium concept subject to the following conditions: The final site plan shall be standardized and reflect all appropriate City standard drawing numbers. The developer shall construct all missing or damaged street improvements to said development per the City of Tustin "Minimum Design Standards of Public Works" and "Street Improvement Standards". This work shall consist of, but is not limited to: curbs and gutters, sidewalks, drve apron, and street pavement. A tentative and final tract map shall be submitted for review and approval. Submission of C.C.&R.'s to the City Attorney shall be quired for review and approval. De The site shall develop a master sign plan per Ordinance No. 684. All conditions of Variance 81-5, as contained in Resolu- tion No. 1995, shall be incorporated into this use per- mit request. A letter from the City's authorized disposal service shall be required in order to review and approve the location of the proposed trash enclosure.
