WITH THE GENERAL MUNICIPAL
RECOMMENDATION:
It is recom~ended that the City Council, at their meeting of February 16, 1982,
adopt Resolution No. 82-14 which provides for the consolidation of the Special
Primary Election with the General Municipal Election in the 35th Senate District.
BACKGROUND:
On January 11, 1982, Governor Brown issued an Election Proclamation for a Special
Election to be held on May 11, 1982, to fill the vacancy (caused by the resignation
of Senator Briggs) in the 35th Senate District.
Section 7201 of the Elections Code reads: "A special primary election shall be
held in the district in which the vacancy occurred on the fourth Tuesday preceding
the day of the special general election at which the vacancy is to be filled.
The State legal counsel concurred that if a City is holding a General Municipal
Election on April 13, 1982, the Special Primary Election should be consolidated
with the General Municipal Election.
