CENTER MEDIAN MODIFICATION ~TION: It is recumtended that the City Council, at their meeting of Feb. 16, 1982, award the contract for subject project to the second low bidder, Hardy & Harper Inc., in the amount of $14,460.00 and authorize return of the 10% bid bond to Noveco Inc. of Corona, CA. BACK~: The City Council, at their meeting of Jan 18, 1982, awarded the contract for subject project to the low bidder, Noveco Inc., in the amount of $14,438.14. The low bidder has been unable, within the prescribed ten working days, to provide a bonding company which meets the requirements of the City Code, which states, "the bonding cc~pany must have a rating of Grade A and Class IX or better in Best's Key Rating Guide." The difference between the low bid and second low bid on this project is only $21.86. Staff is reccmmending that the low bidder's bid bond be returned because, in this case, the 10% bid bond would only amount to $1,443.81. It is doubtful that this amount would cover staff tim~ and attorney's fees in attempting to collect on it. The second low bidder, Hardy & Harper Inc., has previous experience on this type of project as they completed the median modification on First Street at McDonald's Restaurant. DALE A.
