BACK~: On January 18, 1982, the City Council passed and adopted Resolution NO. 82-8, which was awended later by Resolution NO. 82-11, which set the time and place for a public hearing on Underground Utility District No. 6. This hearing has been set for 7:30 PM on Tuesday, February 16, 1982 at the City Council Chambers. This underground district includes an area along both sides of Irvine Blvd. between Yorba St. and Holt Ave. The district is being funded frcm two sources and is outlined in the City Engineer's report, a copy of which is attached. Under a separate action on February 1, 1982, the Tustin Cc~unity Redevelc~m~nt Agency authorized a transfer of 1981-82 funding in the amount of $220,000 from the E1 Camino Real improvement project to Segment B of the subject project. DISCUSSICN: The next required action for this project is that the City Council hold a public hearing on the subject project as scheduled. This hearing will provide all interested persons the opportunity to be heard. U~on receipt of all testimony and at the close of said hearing, the City Council shall take an action to introduce attached ordinance or take no action on the matter. The final action on said ordinance at a later City Council meeting on March 1, 1982 will establish Underground Utility District No. 6. LEVIN, DEPUTY CITY ATTORNEY SUBJECT: UNDERGROUND UTILITY DISTRICT NO. 6 Attached please find the Ordinance establishing the District. We have been able to avoid the necessity for an additional hearing; however, P.U.C. Rule 20 requires the Council to establish the District by ordinance. This of course means that the ordinance will have to be introduced on Tuesday and then adopted at either the next regular Council meeting or an adjourned meeting held at least five days after the meeting on Tuesday. The statutes we are utilizing (Streets and Highways Code Section 5896 . 1 et seq. ) also require that an agreement between the City and the utility have been entered into before the District is established, and that the City or utility has voluntarily agreed to pay at least 50% of the costs of the conversion. Wynn✓ J • M 1 ORDINANCE NO. 868 2 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN CALIFORNIA, ESTABLISHING UNDERGROUND UTILITY DISTRICT 4 NO. 6, IRVINE BOULEVARD, AND DECLARING ITS INTENTION TO ORDER THE CONVERSION 5 6 7 WHEREAS, by Resolutions Nos. 82-8 and 82-11 a public hearing was called for February 16, 1982 at the hour of 7:30 PM in the Council Chambers of the 8 City of Tustin, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and 9 associated structures and the underground installation of wires and facilities for supplying electrical, culmuunication, or similar or associated 10 service, within that certain area of the City of Tustin more particularly described in the legal description and shown on a map marked Exhibit "A" 11 attached hereto. 12 WHEREAS, notice of such hearing has been given to all affected property owners if any, as such are shown on the last equalized assessment roll and to 13 all utilities concerned in the manner and time required by law; and 14 WHEREAS, such hearing has been duly and regularly held and all' persons interested have been given an opportunity to be heard. 15 WHEREAS, the City of Tustin and the Southern California Edison Company 16 have voluntarily agreed to pay over fifty percent (50%) of all costs of conversion; to wit: the City hs agreed to pay fiftyonspercent (51 %) of said 17 costs and the Southern California Edison Company has agreed to pay fortynine percent ( 49%) of said costs. 18 NOW, THEREFORE, the Council of the City of Tustin does hereby ordain: 19 I. The Council hereby finds and determines that the public necessity, 20 health, safety and welfare require the removal of poles, overhead wires and associated structures, 1 ) to eliminate concentrations of overhead 21 distribution facilities, 2) to clear streets used extensively by the general public, which carry a heavy volume of vehicular traffic, and to clear streets 22 which pass through a civic area, and the underground installation of wires 23 and facilities for supplying electric, cawnunication or similar or associated service in the Underground District described in Exhibit "A" attached hereto 24 and made a part hereof by this reference, and pursuant to the provisions of Ordinance No. 411 of the City of Tustin, such area is hereby established as 25 Underground Utility District No. 6, Irvine Boulevard. 26 II. The City Council hereby declares its intention to order the. conversion. 27 28 Ilk 1 III. The Council does hereby fix February 1 , 1983 as the date on which affected property owners, if any, must be ready to receive underground 2 service, and does hereby order the tenvval of all poles, overhead wires and associated overhead structures and the underground installation of wires and 3 facilities for supplying electric, communication or similar or associated service within Underground Utility District No. 6, Irvine Boulevard, on or 4 before February 1 , 1983. 5 IV. The City Clerk is hereby instructed to notify all affected utilities and all persons owning real property, if any, within Underground 6 Utility District No. 6, Irvine Boulevard, of the adoption of this ordinance within ten ( 10) days after the date of such adoption. Said City Clerk shall 7 further notify said property owners, if any, of the necessity that, if they or any person occupying such property desire to continue to receive electric 8 communication or other similar or associated service, they or such occupany shall, by the date fixed in this resolution, provide all necessary facility 9 changes on their premises so as to receive such service frau the lines of the supplying utility or utilities at a new location, subject to applicable 10 rules, regulations and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California. ' R=//3O' j 373.4 t / 966.9; .?•/270''43" d=/'S4 S6" /0' R+/260'Ls 42.N' (I' V 1I IRVINE BOULEVARD UNDERGROUND UTILITY DISTRICT NO 6 EXHIBIT "A" • CITY ENGINEER'S REPORT • IRVINE BOULEVARD UNDERGROUND UTILITY DISTRICT NO. 6 • At their meeting of January 18, 1982, the City Council of the City of Tustin, California, passed and adopted Resolution No. 82-8 calling for a public hearing at 7:30 PM on February 13, 1982, to consider the merits of establishing an • underground utility district along Irvine Boulevard between Yorba Street and Holt Avenue, and more particularly described and shown oh Exhibit "A" attached hereto. • Meetings have been held with the Southern California Edison Company to determine costs involved. The Pacific Telephone Company has no overhead facilities. within the proposed underground district. Camnunicom Cablevision has some overhead facilities within the district that were recently installed without a permit. However, per terms of the franchise agreement with the City, they will be required to underground these facilities at no cost to the district. Funding will be accomplished by two sources. First, the -Portion of the district (Segment A) along Irvine Blvd. between Yorba St. and Prospect Ave. will be funded by Edison Co. Rule 20A funds and second, the remaining portion of the district (Segment B) along Irvine Blvd. between Prospect Ave. and Holt Ave. will be funded by Tustin Community Redevelopment Agency funds. A portion of Segment A, street lighting which is not eligible for Rule 20A funds, will be funded by the City general fund monies. The estimated cost of the proposed underground cork and street lights is as follows: SECG•1ENT A Edison Co. cost for conduit, structure and cable (Rule 20A) $346,270.00 City general fund cost (new street lights) 750.00 SUBTOTAL $347,020.00 SEG'1ENT B Tustin Community Redevelopment Agency. Cost for conduit, structure and partial cable installation (Rule 20B) $356,980.00 Tustin Community Redevelopment Agency Cost (new street lights) 3,018.00 SUBTOTAL $359,998.00 TOTAL COST $707,018.00 There will be no property owner conversion expense as all the existing private utility service lines are presently undergrounded and/or are ready to accept underground service. • • 'Page Two Initial indications by the Edison Company are that their work can be caivleted in 13 months. This district will provide for the removal of all the poles along the easterly side of Yorba Street between Irvine Blvd. and a point 240± feet southerly and both sides of Irvine Blvd. between Yorba St. and Holt Ave. , except for two poles at the southeasterly corner of Prospect Ave. and Irvine Blvd. These poles, numbered 1494904E and 1511160E, must remain until a future undergrounding project, Prospect Ave. , is undertaken.
